A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 87A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§87A-    Annual preventive health risk assessment.  (a)  Every employee-beneficiary who receives health benefits under this chapter shall be required to undergo an annual preventive health risk assessment to be provided by a health benefits plan.

     (b)  Employee-beneficiaries shall be eligible for up to three hours of paid leave during normal business hours to undergo a preventive health risk assessment as provided in subsection (a); provided that the paid leave shall not be credited against vacation or sick leave benefits, if any; provided further that the provision of paid leave shall neither adversely interfere with the operations of the work unit nor require the applicable agency to incur additional human resources or overtime costs.  The employee-beneficiary shall take no more than one appointment with a primary care physician in a single calendar year for purposes of this subsection.  Travel time shall be included as part of the three hours permitted for each assessment.

     (c)  The preventive health risk assessment under this section shall be disclosed to the employee-beneficiary by the medical provider who conducts the health risk assessment.  The assessment shall include medical recommendations and advice for healthy living, if any.  The health risk assessment, medical recommendation, and advice shall remain confidential as provided by law.

     (d)  The carrier of each health benefits plan shall report annually to the board on the cost savings realized to the plan from the preventive health risk assessment for all employee-beneficiaries covered by the plan.

     (e)  Based on the report to the board under subsection (d), the board shall apply any realized cost savings to the unfunded liability of the fund as provided in section 87A-31."

     SECTION 2.  Section 87A-31, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The fund, including any earnings on investments, cost savings realized from the annual preventive health risk assessment under section 87A-   , and rate credits or reimbursements from any carrier or self-insured plan and any earning or interest derived therefrom, may be used to stabilize health and other benefit plan rates; provided that the approval of the governor and the legislature shall be necessary to fund administrative and other expenses necessary to effectuate these purposes."

     SECTION 3.  The board of trustees of the Hawaii employer-union health benefits trust fund shall implement section 1 of this Act no later than the next open enrollment period following approval of this Act.  The department of budget and finance shall assist the board of trustees in implementing section 2 of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
