A BILL FOR AN ACT

 

 

relating to resource land ACQUISITION plan.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that since 2006, section 173A-3, Hawaii Revised Statutes, has required the department of land and natural resources to prepare a resource land acquisition plan.  The purpose of the plan is to guide the board of land and natural resources in determining which lands to acquire for the benefit of the State.  However, despite being aware of this requirement for more than a decade, the department has not yet prepared a plan.

     The legislature further finds that the absence of a resource land acquisition plan has contributed to a deficiency in overall direction and purpose of the land legacy conservation commission and board of land and natural resources with regard to land acquisitions, priorities, policies, and procedures.  Moreover, the fluid nature of the membership of the board of land and natural resources further increases the chances of arbitrary and inconsistent land acquisition decisions that do not further a long-range plan.

     Accordingly, purpose of this Act is to require the department of land and natural resources to prepare a resource land acquisition plan.

     SECTION 2.  (a)  No later than June 30, 2021, the department of land and natural resources shall prepare a resource land acquisition plan pursuant to section 173A-3, Hawaii Revised Statutes.

     (b)  The department of land and natural resources shall submit a report of its progress in complying with subsection (a) to the legislature no later than twenty days prior to the convening of the regular sessions of 2020 and 2021.  Each report shall contain:

     (1)  A timeline for completing the preparation of the resource land acquisition plan;

     (2)  Steps taken by the department of land and natural resources to prepare the resource land acquisition plan; and

     (3)  Proposed legislation, if any.

     SECTION 3.  This Act shall take effect upon its approval.
