THIRTIETH LEGISLATURE, 2019
STATE OF HAWAII

A BILL FOR AN ACT

 

 

Relating to prostitution.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  The legislature finds that the current language used to describe the offense of advancing prostitution is overly broad.  The purpose of this Act is to clarify that a person advancing prostitution includes persons who harm or abuse a prostitute but not persons offering help or assistance to prostitutes facing harm or danger while engaging in prostitution.

     SECTION 2.  Section 712-1201, Hawaii Revised Statutes, is amended by amending subsection (1) to read as follows:

     "(1)  A person "advances prostitution" if, acting other than as a prostitute or a patron of a prostitute, the person knowingly causes or aids a person to commit or engage in prostitution, procures or solicits patrons for prostitution, provides persons for prostitution purposes, permits premises to be regularly used for prostitution purposes, operates or assists in the operation of a house of prostitution or a prostitution enterprise, or engages in any other conduct that is harmful or abusive to a prostitute and designed to institute, aid, or facilitate an act or enterprise of prostitution.  A person shall not be deemed to be "advancing prostitution" if the person assists or offers to assist a prostitute who is being subjected to harm or abuse from another person."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
