SENATE CONCURRENT

RESOLUTION

 

 

ESTABLISHING AN ARCHAEOLOGICAL WORKING GROUP TO RECOMMEND ARCHAEOLOGICAL PRACTICE GUIDELINES FOR THE STATE INCLUDING LICENSING AND PROFESSIONAL OVERSIGHT.

 

 


     WHEREAS, the State Historic Preservation Division of the Department of Land and Natural Resources is charged with accepting archaeological reports that meet the requirements of title 13, chapters 275, 276, 280, and 284, Hawaii Administrative Rules; and

 

WHEREAS, the State Historic Preservation Division of the Department of Land and Natural Resources is also charged with permitting archaeological work in the State of Hawaii in accordance with the requirements of title 13, chapter 282, Hawaii Administrative Rules; and

 

WHEREAS, the adequacy of some archaeological inventory surveys that meet the requirements of title 13, chapter 275, Hawaii Administrative Rules, has been challenged by archaeologists, native Hawaiians, and developers; and

 

WHEREAS, the State Historic Preservation Division is authorized by section 6E-3, Hawaii Revised Statutes, to adopt administrative rules; and

 

WHEREAS, an archaeological working group was created in 2006 to address deficiencies in the State Historic Preservation Program; and

 

WHEREAS, there was agreement that archaeological practices, including reporting, survey practices, and accreditation could be improved, but no action items were generated; and

 

WHEREAS, the profession of archaeology is currently not licensed; and

 

WHEREAS, licensing of the archaeology profession could result in increased professionalism and greater consistency in the quality of the research and analysis in the reports; and

 

WHEREAS, there is a broad constituency interested in preserving archaeological sites; and

 

WHEREAS, many developers and landowners are interested in preserving their rights to develop land with archaeological sites; and

 

WHEREAS, all of these constituents should have input into the development of archaeological guidelines for the State of Hawaii; now, therefore,

 

BE IT RESOLVED by the Senate of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, the House of Representatives concurring, that the Department of Land and Natural Resources establish an archaeological working group to build on the work of the 2006 archaeological working group in the area of developing professional practice guidelines for archaeological work in Hawaii; and

 

BE IT FURTHER RESOLVED that the membership of this archaeological working group shall include staff from the State Historic Preservation Division, a representative of the Island Burial Council, two representatives from the Society for Hawaiian Archaeology, a representative from the military branches, one representative from the Association of Hawaiian Civic Clubs, a representative from the Chamber of Commerce and two representatives designated by the Chairperson of the Board of the Land and Natural Resources; and

 

BE IT FURTHER RESOLVED that the purpose of the archaeological working group is limited to creating guidelines to professionalize the practice of archaeology in Hawaii.  In assessing practices and establishing archaeological guidelines, the archaeological working group is also urged to make recommendations on licensing and professional oversight for archaeology in Hawaii and to make recommendations as to the appropriate agency to oversee the regulation of licensing the profession of archaeology.  In making recommendations, the archaeological working group shall acknowledge balance between research, preservation, and land development that provides guidance and consistency for both the State Historic Preservation Division and developers; and

 

BE IT FURTHER RESOLVED, that the archaeological working group provide a report of its findings and recommendations to the Legislature no later than twenty days prior to the convening of the 2011 Regular Session; and

 

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources, the Director of the Department of Commerce and Consumer Affairs, and the State Auditor.
