SENATE CONCURRENT

RESOLUTION

 

 

Requesting A review OF THE laws and rules relating to confidentiality, privacy, and privilege and their impact on juvenile information sharing.

 

 


     WHEREAS, juvenile information sharing is the sharing of essential information among multiple agencies and across systems using structured processes and procedures to improve outcomes for youth and families; and

 

     WHEREAS, the Office of Juvenile Justice and Delinquency Prevention, the United States Department of Education, and the Substance Abuse and Mental Health Services Administration have identified juvenile information sharing as an essential tool to assist juvenile justice, education, health, and other youth-serving agencies in their efforts to improve services for at-risk and delinquent youth and their families; and

 

     WHEREAS, Hawaii County recognized the need to establish procedures and protocols to facilitate information sharing between state and county agencies in 2000; and

 

     WHEREAS, the Big Island Juvenile Intake and Assessment Center strategic plan concluded in 2007 that existing systems for serving youth were often fragmented and poorly coordinated, families and youth involved with multiple agencies were often confused about which service provider had responsibility for which problem area, and information to officers and program providers was frequently miscommunicated; and

 

     WHEREAS, key justice and government officials in Hawaii have long recognized the need to build integrated information sharing capabilities between justice agencies and other governmental entities throughout the State; and

 

     WHEREAS, justice and government officials in Hawaii also recognize that there is a need for juvenile information sharing to ensure that agencies work in a more collaborative manner, which will lead to more efficient and effective services for youth throughout the State of Hawaii; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, the House of Representatives concurring, that the Department of the Attorney General is requested to identify and examine the following areas relating to juvenile information sharing:

 

     (1)  Existing federal and state laws and local and agency rules relating to confidentiality, privacy, and privilege and their impact on interagency information sharing; and

 

     (2)  Development of a system of interagency information sharing to reduce service redundancy; and

 

     BE IT FURTHER RESOLVED that the Department of the Attorney General is requested to submit a report to the Legislature of its findings and recommendations, including any proposed legislation, no later than twenty days prior to the convening of the Regular Session of 2012; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Attorney General, Director of Human Services, Director of Health, Superintendent of Education, Prosecuting Attorney of each county, and Chief of Police of each county.
