Section
1.
Section
272.15,
Code
2019,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
2A.
Information
required
to
be
reported
3
to
the
board
under
this
section
shall
be
reported
within
4
thirty
days
of
the
date
action
was
taken
which
necessitated
5
the
report,
including
the
date
of
disciplinary
action
taken,
6
nonrenewal
or
termination
of
a
contract
for
reasons
of
alleged
7
or
actual
misconduct,
or
resignation
of
a
person
following
8
an
incident
or
allegation
of
misconduct
as
required
under
9
subsection
1;
or
awareness
of
alleged
misconduct
as
required
10
under
subsection
2.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
13
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
that
information
that
must
be
reported
15
to
the
board
of
educational
examiners
relating
to
alleged
or
16
actual
misconduct
of
certain
school
employees
must
be
reported
17
within
30
days
of
the
date
action
was
taken
which
necessitated
18
the
report.

Under
Code
section
272.15,
a
school
board,
area
education
20
agency
(AEA)
board,
school
superintendent,
the
chief
21
administrator
of
an
AEA,
and
the
authorities
in
charge
of
22
an
accredited
nonpublic
school
must
report
to
the
board
of
23
educational
examiners
any
instance
of
disciplinary
action
taken
24
against
a
licensed
school
employee,
as
well
as
the
nonrenewal
25
or
termination
of
a
person’s
contract
or
the
resignation
of
a
26
person
for
reasons
of
alleged
or
actual
misconduct
when
the
27
person
holds
a
license,
certificate,
or
authorization
issued
28
by
the
board.
In
addition,
an
employee
of
the
department
29
of
education
who
becomes
aware
of
alleged
misconduct
by
an
30
individual
licensed
by
the
board
must
report
the
alleged
31
misconduct
to
the
board.
