Section
1.
Section
249A.38,
subsection
1,
Code
2019,
is

amended
to
read
as
follows:

1.
Following
the
first
thirty
days
of
commitment,
the
3
department
shall
suspend
,
but
not
terminate,
the
eligibility
4
of
an
individual
who
is
an
inmate
of
a
public
institution
as
5
defined
in
42
C.F.R.
§435.1010
,
who
is
enrolled
in
the
medical
6
assistance
program
at
the
time
of
commitment
to
the
public
7
institution,
and
who
remains
eligible
for
medical
assistance
as
8
an
individual
except
for
the
individual’s
institutional
status,
9
during
the
entire
period
of
the
individual’s
commitment
to
the
10
public
institution.

EXPLANATION
12
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
13
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
Medicaid
coverage
of
an
inmate
of
15
a
public
institution
shall
be
suspended,
but
not
terminated,
16
after
the
first
30
days
of
commitment,
and
that
the
suspension
17
shall
continue
during
the
entire
period
of
the
inmate’s
18
commitment
to
the
public
institution.
Prior
to
changes
enacted
19
in
2018
Iowa
Acts,
chapter
1165,
section
127,
the
law
allowed
20
the
suspension
to
continue
only
for
up
to
the
initial
12
months
21
of
an
inmate’s
period
of
commitment
at
which
time
the
inmate’s
22
Medicaid
coverage
would
be
terminated.
