H.F. 237 Section 1. Section 321.194, subsection 2, paragraph a, 1 subparagraph (2), subparagraph divisions (a) and (b), Code 2 2019, are amended to read as follows: 3 (a) Over the most direct and accessible route between 4 the licensee’s residence and schools of enrollment or the 5 closest school bus stop or public transportation service, and 6 between schools of enrollment, for the purpose of attending 7 duly scheduled courses of instruction and extracurricular 8 activities, provided the driving distance between the point of 9 origin and the destination is no more than twenty-five fifty 10 miles. 11 (b) Over the most direct and accessible route between 12 the licensee’s residence or school of enrollment and a site, 13 facility, or school that is not the licensee’s school of 14 enrollment, for the purpose of participating in extracurricular 15 activities conducted at a site, facility, or school designated 16 by the licensee’s school of enrollment for the accommodation of 17 the school’s extracurricular activities, provided the driving 18 distance between the point of origin and the destination is no 19 more than twenty-five fifty miles. 20 Sec. 2. Section 321.194, subsection 3, paragraph f, Code 21 2019, is amended to read as follows: 22 f. The driver’s license shall not be issued for purposes 23 of attending an accredited nonpublic school if the driving 24 distance between the school and the residence of the parent or 25 guardian of the student is more than twenty-five fifty miles. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill relates to operating restrictions on, and the 30 issuance of, special minor’s driver’s licenses for students 31 attending accredited nonpublic schools. Under Code section 32 321.194, a special minor’s driver’s license may be issued to 33 a student between the ages of 14 and 18 years if the student’s 34 school has certified to the department of transportation that 35 -1- LSB 1045YH (1) 88 ns/rh 1/ 2
H.F. 237 the student has a special need for the license. A violation of 1 Code section 321.194 is punishable by a scheduled fine of $50. 2 OPERATING RESTRICTIONS. For students attending accredited 3 nonpublic schools, Code section 321.194 currently limits 4 students to operating motor vehicles during the hours of 5:00 5 a.m. to 10:00 p.m. over the most direct and accessible route 6 between the student’s residence and schools of enrollment 7 or the closest school bus stop or public transportation 8 service, and between schools of enrollment, for the purpose of 9 attending courses and extracurricular activities, and between 10 the student’s residence or school of enrollment and a site, 11 facility, or school that is not the student’s school, for 12 the purpose of participating in extracurricular activities, 13 provided the driving distance between the point of origin and 14 the destination is no more than 25 miles. The bill increases 15 this limitation to no more than 50 miles. 16 LICENSE ISSUANCE. Code section 321.194 prohibits a special 17 minor’s driver’s license from being issued to a student for 18 purposes of attending an accredited nonpublic school if the 19 driving distance between the school and the residence of the 20 parent or guardian of the student is more than 25 miles.
