Section
1.
NEW
SECTION
.
80.48
Public
safety
equipment
fund.
1
1.
A
public
safety
equipment
fund
is
created
in
the
state
2
treasury
under
the
control
of
the
department.
The
fund
shall
3
consist
of
moneys
remitted
by
the
county
treasurer
of
a
county
4
or
by
the
department
of
transportation
which
were
collected
5
through
the
payment
of
a
contribution
made
by
an
applicant
for
6
motor
vehicle
registration
renewal
pursuant
to
section
321.44B
7
and
any
other
moneys
appropriated
to
or
deposited
in
the
fund.
8
Moneys
in
the
fund
are
appropriated
to
the
department
for
the
9
purchase,
maintenance,
and
replacement
of
equipment
used
by
10
the
department.
The
department
is
authorized
to
designate
11
moneys
in
the
fund
for
the
future
purchase,
maintenance,
and
12
replacement
of
equipment
used
by
the
department.

2.
Notwithstanding
section
8.33,
moneys
in
the
fund
14
that
remain
unencumbered
or
unobligated
at
the
close
of
a
15
fiscal
year
shall
not
revert
but
shall
remain
available
for
16
expenditure
for
the
purposes
designated.
Notwithstanding
17
section
12C.7,
subsection
2,
interest
or
earnings
on
moneys
in
18
the
fund
shall
be
credited
to
the
fund.

3.
The
department
shall
submit
a
report
to
the
20
co-chairpersons
and
ranking
members
of
the
joint
appropriations
21
subcommittee
on
the
justice
system
and
to
the
legislative
22
services
agency
on
or
before
December
31
of
each
year
which
23
shall
contain
all
of
the
following:
24
a.
A
list
of
all
expenditures
from
the
fund
made
in
the
25
previous
fiscal
year.
26
b.
The
amount
of
moneys
in
the
fund
carried
over
from
27
the
previous
fiscal
year
to
the
current
fiscal
year
and
28
how
the
department
plans
to
use
those
moneys,
including
any
29
expenditures
in
the
current
fiscal
year.

c.
The
amount
of
moneys
in
the
fund
the
department
intends
31
to
carry
over
from
the
current
fiscal
year
to
the
next
fiscal
32
year
and
how
the
department
plans
to
use
those
moneys.

For
each
application
for
registration
renewal,
the
county
2
treasurer
or
the
department
shall
request
through
use
of
a
3
written
form,
and,
if
the
application
is
made
in
person,
4
through
verbal
communication,
that
an
applicant
make
a
5
voluntary
contribution
of
one
dollar
or
more,
computed
to
the
6
nearest
whole
dollar,
to
the
public
safety
equipment
fund
7
established
pursuant
to
section
80.47.
One
hundred
percent
8
of
the
moneys
collected
by
the
county
and
one
hundred
percent
9
of
the
moneys
collected
by
the
department
in
the
form
of
10
contributions
shall
be
remitted
to
the
treasurer
of
state
for
11
deposit
in
the
public
safety
equipment
fund
to
be
used
for
the
12
purposes
specified
for
the
fund.
However,
up
to
five
percent
13
of
the
moneys
collected
by
the
county
may
be
retained
by
the
14
county
treasurer
for
deposit
in
the
general
fund
of
the
county.
15
The
director
shall
adopt
rules
to
administer
this
section.

Sec.
3.
Section
331.557,
subsection
1,
Code
2020,
is
amended
17
to
read
as
follows:

1.
Issue,
renew,
and
replace
lost
or
damaged
vehicle
19
registration
cards
or
plates
,
and
issue
and
transfer
20
certificates
of
title
for
vehicles
,
and
collect
voluntary
21
contributions,
as
provided
in
sections
321.17
to
through
22
321.52
.

Sec.
4.
EFFECTIVE
DATE.
This
Act
takes
effect
January
1,
24
2021.

EXPLANATION
26
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
27
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
creates
a
public
safety
equipment
fund
and
29
appropriates
moneys
in
the
fund
to
the
department
of
public
30
safety
(DPS)
for
the
purchase,
maintenance,
and
replacement
of
31
equipment
used
by
DPS.
The
bill
authorizes
DPS
to
designate
32
moneys
in
the
fund
for
future
purchase,
maintenance,
and
33
replacement
of
equipment
used
by
DPS.
The
bill
also
provides
34
for
certain
reporting
requirements
regarding
how
the
moneys
in

the
fund
are
used,
including
the
amount
carried
over
annually
1
in
the
fund.

The
bill
provides
that
for
each
application
for
motor

vehicle
registration
renewal,
the
county
treasurer

(DOT)
shall

of
a

form,
and,
if
the
application
is
made
in
