  1 An Act relating to the elimination of the exemption from
  2    immunization of a person related to conflicts with the
  3    tenets and practices of a recognized religious denomination.
  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 139A.8, subsection 4, Code 2017, is
  1  2 amended to read as follows:
  1  3    4.  a.  Immunization is not required for a person's
  1  4 enrollment in any elementary or secondary school or licensed
  1  5 child care center if either of the following applies:
  1  6    (1)  The the applicant, or if the applicant is a minor, the
  1  7 applicant's parent or legal guardian, submits to the admitting
  1  8 official a statement signed by a physician, advanced registered
  1  9 nurse practitioner, or physician assistant who is licensed by
  1 10 the board of medicine, board of nursing, or board of physician
  1 11 assistants that the immunizations required would be injurious
  1 12 to the health and well=being of the applicant or any member of
  1 13 the applicant's family.
  1 14    (2)  The applicant, or if the applicant is a minor, the
  1 15 applicant's parent or legal guardian, submits an affidavit
  1 16 signed by the applicant, or if the applicant is a minor,
  1 17 the applicant's parent or legal guardian, stating that the
  1 18 immunization conflicts with the tenets and practices of a
  1 19 recognized religious denomination of which the applicant is an
  1 20 adherent or member.
  1 21    b.  The exemptions exemption under this subsection do does
  1 22  not apply in times of emergency or epidemic as determined by
  1 23 the state board of health and as declared by the director of
  1 24 public health.
  1 25                           EXPLANATION
  1 26 The inclusion of this explanation does not constitute agreement with
  1 27 the explanation's substance by the members of the general assembly.
  1 28    This bill eliminates the exemption from required
  1 29 immunization for a person's enrollment in any elementary
  1 30 or secondary school or licensed child care center  relating
  1 31 to conflicts with the tenets and practices of a recognized
  1 32 religious denomination of which the applicant is an adherent
  1 33 or member.
