  1  1    Section 1.  Section 257.8, subsections 1 and 2, Code 2015,
  1  2 are amended to read as follows:
  1  3    1.  State percent of growth.  The state percent of growth
  1  4 for the budget year beginning July 1, 2012, is two percent.
  1  5  The state percent of growth for the budget year beginning July
  1  6 1, 2013, is two percent. The state percent of growth for the
  1  7 budget year beginning July 1, 2014, is four percent. The state
  1  8 percent of growth for each subsequent budget year shall be
  1  9 established by statute which shall be enacted within thirty
  1 10 days of the submission in the year preceding the base year of
  1 11 the governor's budget under section 8.21.  However, if the
  1 12 statute establishing the state percent of growth for a budget
  1 13 year is not enacted within thirty days of the submission in the
  1 14 year preceding the base year of the governor's budget under
  1 15 section 8.21, the state percent of growth for that budget year
  1 16 is four percent. The establishment of the state percent of
  1 17 growth for a budget year shall be the only subject matter of
  1 18 the bill which enacts the state percent of growth for a budget
  1 19 year.
  1 20    2.  Categorical state percent of growth.  The categorical
  1 21 state percent of growth for the budget year beginning July 1,
  1 22 2012, is two percent. The categorical state percent of growth
  1 23 for the budget year beginning July 1, 2013, is two percent.
  1 24 The categorical state percent of growth for the budget year
  1 25 beginning July 1, 2014, is four percent. The categorical state
  1 26 percent of growth for each budget year shall be established
  1 27 by statute which shall be enacted within thirty days of
  1 28 the submission in the year preceding the base year of the
  1 29 governor's budget under section 8.21.  However, if the statute
  1 30 establishing the categorical state percent of growth for a
  1 31 budget year is not enacted within thirty days of the submission
  1 32 in the year preceding the base year of the governor's budget
  1 33 under section 8.21, the categorical state percent of growth
  1 34 for that budget year is four percent. The establishment of
  1 35 the categorical state percent of growth for a budget year
  2  1 shall be the only subject matter of the bill which enacts the
  2  2 categorical state percent of growth for a budget year. The
  2  3 categorical state percent of growth may include state percents
  2  4 of growth for the teacher salary supplement, the professional
  2  5 development supplement, the early intervention supplement, and
  2  6 the teacher leadership supplement.
  2  7    Sec. 2.  APPLICABILITY.  This Act applies to school budget
  2  8 years beginning on or after July 1, 2016.
  2  9                           EXPLANATION
  2 10 The inclusion of this explanation does not constitute agreement with
  2 11 the explanation's substance by the members of the general assembly.
  2 12    This bill modifies the requirements for enacting the state
  2 13 percent of growth and the categorical state percent of growth
  2 14 under Code section 257.8.
  2 15    Current law requires the state percent of growth and the
  2 16 categorical state percent of growth to be established by
  2 17 statute within 30 days of the submission of the governor's
  2 18 budget in the year preceding the base year. The bill
  2 19 provides that if the statute establishing the state percent
  2 20 of growth for a budget year is not enacted within 30 days of
  2 21 the submission in the year preceding the base year of the
  2 22 governor's budget under Code section 8.21, the state percent of
  2 23 growth for that budget year is 4 percent.  The bill establishes
  2 24 a similar requirement for the failure to enact the statute
  2 25 establishing the categorical state percent of growth for a
  2 26 budget year.
  2 27    The bill applies to school budget years beginning on or after
  2 28 July 1, 2016.
