H.F. 493 Section 1. Section 257.31, subsection 5, unnumbered 1 paragraph 1, Code 2019, is amended to read as follows: 2 If a district has unusual circumstances, creating an unusual 3 need for additional funds, including but not limited to the 4 circumstances enumerated in paragraphs “a” through “n” “o” , 5 the committee may grant supplemental aid to the district from 6 any funds appropriated to the department of education for the 7 use of the school budget review committee for the purposes of 8 this subsection . The school budget review committee shall 9 review a school district’s unexpended fund balance prior to 10 any decision regarding unusual finance circumstances. Such 11 aid shall be miscellaneous income and shall not be included in 12 district cost. In addition to or as an alternative to granting 13 supplemental aid the committee may establish a modified 14 supplemental amount for the district. The school budget review 15 committee shall review a school district’s unspent balance 16 prior to any decision to establish a modified supplemental 17 amount under this subsection . 18 Sec. 2. Section 257.31, subsection 5, Code 2019, is amended 19 by adding the following new paragraph: 20 NEW PARAGRAPH . o. For the payment of fees or costs 21 associated with school courses or programs that are not charged 22 to pupils as the result of the pupil’s eligibility for free and 23 reduced price meals under the federal National School Lunch Act 24 and the federal Child Nutrition Act of 1966, 42 U.S.C. §1751 25 et seq. 26 Sec. 3. APPLICABILITY. This Act applies to school budget 27 years beginning on or after July 1, 2019. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 If a school district has one or more of the unusual 32 circumstances enumerated in Code section 257.31(5), creating 33 an unusual need for additional funds, the school budget review 34 committee may grant supplemental aid to the school district 35 -1- LSB 2548YH (3) 88 md/jh 1/ 2
H.F. 493 from any funds appropriated to the department of education 1 for the use of the school budget review committee or, in 2 addition to or as an alternative to granting supplemental aid, 3 the school budget review committee may establish a modified 4 supplemental amount for the district. 5 This bill adds the payment of fees or costs associated with 6 school courses or programs that are not charged to pupils as 7 the result of the pupil’s eligibility for free and reduced 8 price meals under federal law to the list of enumerated 9 circumstances for which supplemental aid or a modified 10 supplemental amount may be approved by the school budget review 11 committee. 12 The bill applies to school budget years beginning on or after 13 July 1, 2019. 14 -2- LSB 2548YH (3) 88 md/jh 2/ 2
