H.F. 658 Section 1. Section 135.25, Code 2019, is amended to read as 1 follows: 2 135.25 Emergency medical services fund. 3 An emergency medical services fund is created in the state 4 treasury under the control of the department. The fund 5 includes, but is not limited to, amounts appropriated by the 6 general assembly, and other moneys available from federal or 7 private sources which are to be used for purposes of this 8 section . Funds remaining in the fund at the end of each 9 fiscal year shall not revert to the general fund of the state 10 but shall remain in the emergency medical services fund, 11 notwithstanding section 8.33 . The fund is established to 12 assist counties by matching, on a dollar-for-dollar basis, 13 moneys spent by a county for the acquisition of equipment for 14 the provision of emergency medical services and by providing 15 grants to counties for education and training in the delivery 16 of emergency medical services, as provided in this section 17 and section 422D.6 . A county seeking matching funds under 18 this section shall apply to the emergency medical services 19 division of the department. Moneys deposited in the fund 20 pursuant to section 805.8A, subsection 5, paragraph “a” , 21 subparagraph (5), and section 805.8A, subsection 14, paragraph 22 “i” , subparagraph (4), shall be allocated as required under 23 this section, but shall be used to assist counties in providing 24 emergency medical services in rural, underserved areas of 25 the state. The department shall adopt rules concerning the 26 application and awarding process for the matching funds and 27 the criteria for the allocation of moneys in the fund if the 28 moneys are insufficient to meet the emergency medical services 29 needs of the counties. Moneys allocated by the department to a 30 county for emergency medical services purposes may be used for 31 equipment or training and education as determined by the board 32 of supervisors pursuant to section 422D.6 . 33 Sec. 2. Section 805.8A, subsection 5, paragraph a, 34 subparagraph (5), Code 2019, is amended to read as follows: 35 -1- LSB 2337HV (1) 88 ns/rh 1/ 3
H.F. 658 (5) One hundred dollars plus five ten dollars for each mile 1 per hour of excessive speed over twenty miles per hour over the 2 limit. Notwithstanding section 805.12, fifty percent of each 3 fine collected pursuant to this subparagraph, excluding the 4 first one hundred dollars of each fine, shall be submitted to 5 the state court administrator and transferred to the department 6 of public health for deposit in the emergency medical services 7 fund created in section 135.25. 8 Sec. 3. Section 805.8A, subsection 14, paragraph i, 9 subparagraph (4), Code 2019, is amended to read as follows: 10 (4) One thousand five hundred dollars for speed greater 11 than twenty-five miles per hour over the posted speed limit. 12 Notwithstanding section 805.12, five hundred dollars of 13 each fine collected pursuant to this subparagraph shall be 14 submitted to the state court administrator and transferred to 15 the department of public health for deposit in the emergency 16 medical services fund created in section 135.25. 17 Sec. 4. APPLICABILITY. This Act applies to penalties paid 18 for violations occurring on or after the effective date of this 19 Act. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill increases the scheduled fine for speeding pursuant 24 to Code sections 321.236(5) (power of local authorities to 25 regulate speed in public parks) and (11) (power of local 26 authorities to regulate speed in public alleys), 321.285 27 (general speed restrictions), and 461A.36 (speed limits in 28 state parks and preserves), from $100 plus $5 for each mile per 29 hour of excessive speed over 20 miles per hour over the limit 30 to $100 plus $10 for each mile per hour of excessive speed over 31 20 miles per hour over the limit. The bill also increases the 32 scheduled fine for speeding in a road work zone more than 25 33 miles per hour over the limit from $1,000 to $1,500. 34 The bill requires the additional moneys collected to be 35 -2- LSB 2337HV (1) 88 ns/rh 2/ 3
H.F. 658 submitted to the state court administrator and transferred to 1 the department of public health for deposit in the emergency 2 medical services fund. The additional moneys must be allocated 3 as set forth under current law, but are required to be used 4 to assist counties in providing emergency medical services in 5 rural, underserved areas of the state. Under current law, 6 moneys in the emergency medical services fund are used to 7 assist counties by matching, on a dollar-for-dollar basis, 8 moneys spent by a county for the acquisition of equipment for 9 the provision of emergency medical services and by providing 10 grants to counties for education and training in the delivery 11 of emergency medical services. 12 The bill applies to penalties paid for violations occurring 13 on or after the effective date of the bill. 14 -3- LSB 2337HV (1) 88 ns/rh 3/ 3
