H.J.R. 1 Section 1. The following amendment to the Constitution of 1 the State of Iowa is proposed: 2 Section 5 of Article II of the Constitution of the State of 3 Iowa, as amended by the amendment of 2008, is repealed and the 4 following adopted in lieu thereof: 5 Sec. 5. Disqualified persons. A person adjudged mentally 6 incompetent to vote shall not be entitled to the privilege of 7 an elector. A person convicted of any infamous crime shall not 8 be entitled to the privilege of an elector unless the privilege 9 has been restored by executive action or by operation of law 10 enacted by the general assembly. 11 Sec. 2. REFERRAL AND PUBLICATION. The foregoing proposed 12 amendment to the Constitution of the State of Iowa is referred 13 to the general assembly to be chosen at the next general 14 election for members of the general assembly, and the secretary 15 of state is directed to cause the proposed amendment to be 16 published for three consecutive months previous to the date of 17 that election as provided by law. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This joint resolution proposes an amendment to the 22 Constitution of the State of Iowa relating to the restoration 23 of voting rights to felons. The amendment provides that the 24 voting rights of felons may be restored by operation of law 25 enacted by the general assembly in addition to by executive 26 action. 27 The resolution, if adopted, would be published and then 28 referred to the next general assembly (89th) for adoption, 29 before being submitted to the electorate for ratification. 30 -1- LSB 1325HH (4) 88 ss/jh 1/ 1
