H.F. _____ Section 1. Section 235F.1, subsection 17, Code 2019, is 1 amended to read as follows: 2 17. “Vulnerable elder” means a person sixty years of age or 3 older who is unable to protect himself or herself from elder 4 abuse as a result of age or and a mental or physical condition. 5 EXPLANATION 6 The inclusion of this explanation does not constitute agreement with 7 the explanation’s substance by the members of the general assembly. 8 Currently, under Code section 235F.1(17), “vulnerable elder” 9 is defined as a person 60 years of age or older who is unable to 10 protect himself or herself from elder abuse either as a result 11 of the person’s age or as a result of the person’s mental or 12 physical condition. This bill modifies this definition to 13 provide that a “vulnerable elder” is a person 60 years of age 14 or older who is unable to protect himself or herself from 15 elder abuse as a result of both the person’s age and mental or 16 physical condition. 17 -1- LSB 1463YC (1) 88 mo/rh 1/ 1
