S.F. _____ H.F. _____ Section 1. NEW SECTION . 29C.7 Hazard mitigation financial 1 assistance. 2 1. If financial assistance is granted by the federal 3 government under the federal Robert T. Stafford Disaster Relief 4 and Emergency Assistance Act, Pub. L. No. 93-288, as amended, 5 42 U.S.C. 5121 et seq. or the federal National Flood Insurance 6 Reform Act of 1994, Pub. L. No. 103-325, 42 U.S.C. 4001 et seq. 7 for hazard mitigation and section 29C.6 is not applicable, 8 the state may participate in the funding of the financial 9 assistance authorized to a local government in an amount not 10 to exceed ten percent of the eligible expenses, with the 11 applicant providing the balance of any participation amount. 12 If financial assistance is granted by the federal government as 13 described in this section for state-related hazard mitigation, 14 the state may participate in the funding of the financial 15 assistance authorized, not to exceed fifty percent of the total 16 eligible expenses. 17 2. State participation in funding financial assistance to 18 local government under subsection 1 is contingent upon the 19 local government having on file a state-approved, comprehensive 20 emergency plan which meets the standards adopted pursuant to 21 section 29C.9, subsection 8. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill concerns financial assistance granted by the 26 federal government for hazard mitigation when Code section 27 29C.6, relating to a proclamation of disaster emergency by the 28 governor, is not applicable. 29 The bill provides that if financial assistance for hazard 30 mitigation is granted under the federal Robert T. Stafford 31 Disaster Relief and Emergency Assistance Act or the federal 32 National Flood Insurance Reform Act of 1994, the state may 33 participate in the funding of the financial assistance 34 authorized to a local government in an amount not to exceed 35 -1- LSB 5381DP (3) 88 ec/rn 1/ 2

In addition, the 1 bill provides that if financial assistance is granted for 2 state-related hazard mitigation, the state may participate 3 in the funding in an amount not to exceed 50 percent of the 4 total eligible expenses.
