S.F. 110 Section 1. Section 142D.2, Code 2019, is amended by adding 1 the following new subsections: 2 NEW SUBSECTION . 9A. “Gambling game” means the same as 3 defined in section 99F.1. 4 NEW SUBSECTION . 9B. “Gaming floor” means the same as 5 defined in section 99F.1. 6 Sec. 2. Section 142D.4, subsection 10, Code 2019, is amended 7 to read as follows: 8 10. Only the portion of the gaming floor of a premises 9 licensed pursuant to chapter 99F where smoking is allowed, 10 exclusive of any bar or restaurant located within the gaming 11 floor which is an enclosed area and subject to the prohibitions 12 of section 142D.3 , if the gaming floor is apportioned to 13 provide an equal quantity of the type of gambling game 14 authorized by the state racing and gaming commission for the 15 licensed premises in both an area where smoking is allowed and 16 an area where smoking is prohibited, and if smoke from the area 17 where smoking is allowed does not infiltrate into the area 18 where smoking is prohibited . 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill relates to smoking on gaming floors. The bill 23 amends the exception under the smokefree air Act allowing 24 smoking on the gaming floors of the premises licensed 25 pursuant to Code chapter 99F (gambling structures, excursion 26 gambling boats, and racetracks) to provide that smoking 27 is not prohibited only on the portion of the gaming floor 28 where smoking is allowed, if the gaming floor is apportioned 29 to provide an equal quantity of the type of gambling game 30 authorized by the state racing and gaming commission for the 31 licensed premises in both an area where smoking is allowed and 32 an area where smoking is prohibited, and if smoke from the area 33 where smoking is allowed does not infiltrate into the area 34 where smoking is prohibited. 35 -1- LSB 1734XS (2) 88 pf/rh 1/ 1
