Section 139A.8, subsection 4, paragraph a, 1 2 subparagraph (2), Code 2017, is amended to read as follows: 1 3 (2) The applicant, or if the applicant is a minor, the 1 4 applicant's parent or legal guardian, submits an affidavit 1 5 signed by both the applicant, or if the applicant is a minor, 1 6 the applicant's parent or legal guardian, and the leader of the 1 7 local congregation of a recognized religious denomination of 1 8 which the applicant is an adherent or member, stating that the 1 9 immunization conflicts with the tenets and practices ofathe 1 10 recognized religious denominationofto which theapplicant 1 11 is an adherent or memberlocal congregation belongs, and 1 12 that the applicant is a member in good standing of the local 1 13 congregation. 1 14 EXPLANATION 1 15 The inclusion of this explanation does not constitute agreement with 1 16 the explanation's substance by the members of the general assembly. 1 17 This bill relates to the obtaining of a religious exemption 1 18 from the required immunization of a person enrolling in any 1 19 elementary or secondary school or a licensed child care center. 1 20 Currently, an applicant, or if the applicant is a minor, the 1 21 applicant's parent or legal guardian, must submit an affidavit 1 22 signed by the applicant, or if the applicant is a minor, the 1 23 applicant's parent or legal guardian, stating that the required 1 24 immunization conflicts with the tenets and practices of a 1 25 recognized religious denomination of which the applicant is an 1 26 adherent or member in order to be exempt from the immunization 1 27 requirement. The bill amends this provision to also require 1 28 that, in addition to the applicant, or the applicant's parent 1 29 or legal guardian, the leader of the local congregation of a 1 30 recognized religious denomination of which the applicant is 1 31 an adherent or member, sign the affidavit stating that the 1 32 required immunization conflicts with the tenets and practices 1 33 of the recognized religious denomination to which the local 1 34 congregation belongs and that the applicant is a member in good 1 35 standing of the local congregation.
