  1  1    Section 1.  Section 272.10, subsections 2 and 3, Code 2017,
  1  2 are amended to read as follows:
  1  3    2.  Licensing fees are payable to the treasurer of state and
  1  4 shall be deposited with the executive director of the board.
  1  5 The executive director shall deposit twenty=five percent of
  1  6 the fees collected annually with the treasurer of state and
  1  7 the fees shall be credited to the general fund of the state.
  1  8  The remaining licensing fees collected during the fiscal year
  1  9 shall be retained by and are appropriated to the board for
  1 10 the purposes related to the board's duties. Notwithstanding
  1 11 section 8.33, licensing fees retained by and appropriated to
  1 12 the board pursuant to this section that remain unencumbered or
  1 13 unobligated at the close of the fiscal year shall not revert
  1 14 but shall remain available for expenditure for the activities
  1 15 of the board as provided in this chapter until the close of the
  1 16 succeeding fiscal year.
  1 17    3.  The executive director shall keep an accurate and
  1 18 detailed account of licensing fees received, including fees
  1 19 paid to the treasurer of state and fees retained by the board.
  1 20    Sec. 2.  BOARD OF EDUCATIONAL EXAMINERS LICENSING FEE
  1 21 REDUCTION FOR 2017=2018 ==== EMERGENCY RULES.
  1 22    1.  The board of educational examiners shall reduce, for the
  1 23 fiscal year beginning July 1, 2017, the licensing fees assessed
  1 24 under chapter 272 by not less than twenty=five percent of the
  1 25 licensing fees established by rule and assessed during the
  1 26 2016=2017 fiscal year.
  1 27    2.  The board of educational examiners may adopt emergency
  1 28 rules under section 17A.4, subsection 3, and section 17A.5,
  1 29 subsection 2, paragraph "b", to implement the provisions of
  1 30 this Act and the rules shall be effective immediately upon
  1 31 filing unless a later date is specified in the rules.  Any
  1 32 rules adopted in accordance with this section shall also be
  1 33 published as a notice of intended action as provided in section
  1 34 17A.4.
  1 35    Sec. 3.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed of
  2  1 immediate importance, takes effect upon enactment.
  2  2                           EXPLANATION
  2  3 The inclusion of this explanation does not constitute agreement with
  2  4 the explanation's substance by the members of the general assembly.
  2  5    This bill eliminates a provision that requires the director
  2  6 of the board of educational examiners to deposit with the
  2  7 treasurer of state 25 percent of the licensing fees collected
  2  8 by the board.  Under the provision, the moneys deposited are
  2  9 credited to the general fund of the state.  The bill also
  2 10 requires the board to reduce its fees by 25 percent for the
  2 11 2017=2018 fiscal year.  The board may adopt emergency rules to
  2 12 implement the fee reduction.
  2 13    The bill takes effect upon enactment.
