1.
IOWA
BOARD
OF
VETERINARY
MEDICINE

OF

STATUTES
AND
RULES

1.
a.
The
Iowa
board
of
veterinary
medicine
shall
conduct
3
a
review
of
provisions
in
chapter
169
and
its
rules,
regulating
4
auxiliary
personnel,
including
but
not
limited
to
veterinary
5
assistants
and
veterinary
technicians,
employed
by
licensed
6
veterinarians.
The
board
shall
determine
the
extent
to
which
7
chapter
169
and
its
rules
should
be
amended
in
order
to
ensure
8
all
of
the
following:

(1)
The
rules
are
based
on
statute
delegating
authority
to
10
the
board
to
adopt
such
rules.
11
(2)
The
statutes
and
rules
provide
that
auxiliary
personnel
12
perform
procedures
on
animals
that
are
ancillary
to,
and
not
13
within,
the
scope
of
the
practice
of
veterinary
medicine
as
14
defined
in
section
169.3,
subsection
10,
paragraph
“a”.

(3)
The
statutes
and
rules
include
requirements
that
16
auxiliary
personnel
act
under
the
direct
supervision
and
17
control
of
a
licensed
veterinarian.

(4)
The
statutes
and
rules
provide
definitions
for
all
19
auxiliary
personnel
titles
that
are
separated
based
on
required
20
experience,
training,
education,
and
examination.
21
(5)
The
statutes
and
rules
include
requirements
for
board
of
22
veterinary
medicine
certification
of
auxiliary
personnel.
23
(6)
The
statutes
and
rules
include
requirements
that
24
auxiliary
personnel
post
their
credentials
at
the
principal
25
office
of
the
licensed
veterinarian
who
is
the
employer.

b.
As
part
of
its
review,
the
board
may
also
identify
and
27
eliminate
any
rule
that
is
outdated,
redundant,
or
inconsistent
28
with
statute
or
its
own
rules.

2.
In
conducting
its
review,
the
board
shall
consult
30
with
interested
organizations,
including
the
Iowa
veterinary
31
medical
association,
and
conduct
hearings
in
which
licensed
32
veterinarians
are
invited
to
participate.

3.
On
or
before
January
10,
2020,
the
board
shall
complete
34
its
review
and
submit
a
report
summarizing
its
findings
and

recommendations
to
the
secretary
of
agriculture
and
the
general
1
assembly,
including
the
administrative
rules
review
committee.

The
report
shall
include
any
proposed
legislation
amending
3
chapter
169
and
proposed
rules
to
be
submitted
as
a
notice
of
4
intended
action
under
section
17A.

Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
6
importance,
takes
effect
upon
enactment.

EXPLANATION
8
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
9
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
Iowa
board
of
veterinary
medicine
11
(board)
to
conduct
a
review
of
provisions
in
its
enabling
12
statute
(Code
chapter
169)
including
its
administrative
rules,
13
as
they
relate
to
the
regulation
of
veterinary
assistants,
14
veterinary
technicians,
and
other
auxiliary
personnel.
As
15
part
of
its
review,
the
board
must
consult
with
interested
16
organizations
and
conduct
hearings
in
which
licensed
17
veterinarians
are
invited
to
participate.
Upon
completion
18
of
its
review,
on
or
before
January
10,
2020,
the
board
must
19
submit
a
report
summarizing
its
findings
and
recommendations
20
to
the
secretary
of
agriculture
and
the
general
assembly,
21
including
the
administrative
rules
review
committee.
