S.F. 239 Section 1. Section 139A.8, subsection 4, paragraph a, Code 1 2019, is amended to read as follows: 2 a. Immunization is not required for a person’s enrollment 3 in any elementary or secondary school or licensed child care 4 center if either any of the following applies: 5 (1) The applicant, or if the applicant is a minor, the 6 applicant’s parent or legal guardian, submits to the admitting 7 official a statement signed by a physician, advanced registered 8 nurse practitioner, or physician assistant who is licensed by 9 the board of medicine, board of nursing, or board of physician 10 assistants that the immunizations required would could be 11 injurious to the health and well-being of the applicant or any 12 member of the applicant’s family. 13 (2) The applicant, or if the applicant is a minor, the 14 applicant’s parent or legal guardian, submits an affidavit 15 signed by the applicant, or if the applicant is a minor, 16 the applicant’s parent or legal guardian, stating that the 17 immunization conflicts with the tenets and practices of 18 a recognized religious denomination beliefs of which the 19 applicant is an adherent or member . 20 (3) The applicant, or if the applicant is a minor, the 21 applicant’s parent or legal guardian, submits an affidavit 22 signed by the applicant, or if the applicant is a minor, signed 23 by the applicant’s parent or legal guardian, stating that the 24 immunization conflicts with the conscientiously held beliefs 25 of the applicant, or if the applicant is a minor, of the 26 applicant’s parent or legal guardian. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 This bill relates to exemptions from immunization required 31 for a person’s enrollment in any elementary or secondary school 32 or licensed child care center. 33 The bill amends the existing medical exemption provision 34 to require that the statement signed by the health care 35 -1- LSB 1601XS (3) 88 pf/rh 1/ 2
S.F. 239 professional and submitted to the admitting official must state 1 that the immunizations required could, rather than would, be 2 injurious to the health and well-being of the applicant or any 3 member of the applicant’s family. 4 The bill amends the existing religious exemption provision 5 to provide that the affidavit signed and submitted must state 6 that the immunization conflicts with the religious beliefs of 7 the applicant, not the tenets and practices of a recognized 8 religious denomination of which the applicant is an adherent 9 or member. 10 The bill also includes a new exemption that includes as 11 a basis for exemption, the submission of a signed affidavit 12 by the applicant, or if the applicant is a minor, by the 13 applicant’s parent or legal guardian, stating that the 14 immunization conflicts with the conscientiously held beliefs 15 of the applicant, or if the applicant is a minor, of the 16 applicant’s parent or legal guardian. 17 Existing provisions direct the department of public 18 health, in consultation with the director of the department of 19 education, to adopt rules to implement the bill. 20 -2- LSB 1601XS (3) 88 pf/rh 2/ 2
