S.F. 326 Section 1. NEW SECTION . 280.13D Limitation on expenditure 1 of certain public moneys for high school athletic organizations. 2 1. For purposes of this section, “organization” means the 3 same as defined in section 280.13. 4 2. On or after January 1, 2022, a school district shall not 5 expend any moneys to pay dues or membership fees to the Iowa 6 high school athletic association or the Iowa girls high school 7 athletic union. On or after January 1, 2022, a school district 8 may expend moneys to pay dues or membership fees to a single 9 organization that is a successor organization to both the Iowa 10 high school athletic association and the Iowa girls high school 11 athletic union. 12 3. On or after January 1, 2022, an accredited or 13 unaccredited nonpublic school shall not expend any moneys 14 originating from the state to pay dues or membership fees to 15 the Iowa high school athletic association or the Iowa girls 16 high school athletic union. On or after January 1, 2022, an 17 accredited or unaccredited nonpublic school may expend moneys 18 originating from the state to pay dues or membership fees to a 19 single organization that is a successor organization to both 20 the Iowa high school athletic association and the Iowa girls 21 high school athletic union. 22 Sec. 2. NOTIFICATION OF DEPARTMENT OF EDUCATION —— REPORT TO 23 GENERAL ASSEMBLY. 24 1. If the Iowa high school athletic association or the 25 Iowa girls high school athletic union ceases to operate as an 26 independent organization, as defined in section 280.13, the 27 Iowa high school athletic association or the Iowa girls high 28 school athletic union shall, prior to cessation of operation, 29 notify the department of education in writing of the date on 30 which such operation shall cease. 31 2. Upon receiving written notice pursuant to subsection 32 1, the department of education shall submit a report to 33 the governor and the general assembly within sixty days 34 recommending any legislation necessary to reflect the cessation 35 -1- LSB 2477XS (1) 88 je/rn 1/ 2
S.F. 326 of operation of the Iowa high school athletic association or 1 the Iowa girls high school athletic union and the commencement 2 of operation of any successor organization. 3 EXPLANATION 4 The inclusion of this explanation does not constitute agreement with 5 the explanation’s substance by the members of the general assembly. 6 This bill prohibits a school district from expending any 7 moneys to pay dues or membership fees to the Iowa high school 8 athletic association (IHSAA) or the Iowa girls high school 9 athletic union (IGHSAU) on or after January 1, 2022. The bill 10 authorizes a school district to expend moneys to pay dues or 11 membership fees to a single organization that is a successor 12 organization to both the IHSAA and the IGHSAU on or after 13 January 1, 2022. The bill contains similar requirements for 14 the expenditure of any moneys originating from the state by an 15 accredited or unaccredited nonpublic school. 16 If the IHSAA or the IGHSAU ceases to operate as an 17 independent organization, the bill requires the IHSAA or the 18 IGHSAU to notify the department of education in writing of the 19 date on which such operation shall cease prior to cessation 20 of operation. Upon receiving such notice, the bill requires 21 the department to submit a report to the governor and the 22 general assembly within 60 days recommending any legislation 23 necessary to reflect the cessation of operation of the IHSAA or 24 the IGHSAU and the commencement of operation of any successor 25 organization. 26 -2- LSB 2477XS (1) 88 je/rn 2/ 2
