S.F. 486 Section 1. Section 321.279, Code 2019, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4. Notwithstanding section 809.5 or any 3 other provision of law to the contrary, a law enforcement 4 agency may retain possession of a motor vehicle suspected to 5 have been operated by a person in violation of this section 6 until final disposition of any criminal proceeding related 7 to the violation if the person was a registered owner of the 8 vehicle at the time of the suspected violation. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill allows a law enforcement agency to retain 13 possession of a vehicle suspected to have been operated by a 14 person eluding or attempting to elude a law enforcement vehicle 15 until final disposition of any criminal proceeding related 16 to the violation if the person was a registered owner of the 17 vehicle at the time of the suspected violation. 18 -1- LSB 1304SV (1) 88 ns/rh 1/ 1
