S.F. 86 Section 1. Section 142C.2, subsection 6, Code 2019, is 1 amended to read as follows: 2 6. “Document of gift” means a donor card or other record 3 used to make an anatomical gift, including a statement or 4 symbol on a driver’s license , or identification card, or 5 hunting, fishing, or fur harvester license, or an entry in a 6 donor registry. 7 Sec. 2. Section 142C.2, Code 2019, is amended by adding the 8 following new subsection: 9 NEW SUBSECTION . 13A. “Hunting, fishing, or fur harvester 10 license” means a license issued by the department of natural 11 resources or an authorized license agent pursuant to chapter 12 483A. 13 Sec. 3. Section 142C.3, subsection 1, paragraph a, Code 14 2019, is amended by adding the following new subparagraph: 15 NEW SUBPARAGRAPH . (4) A minor, if the minor is authorized 16 under state law to apply for a hunting, fishing, or fur 17 harvester license, the minor is at least 14 years of age, and 18 the minor authorizes a symbol indicating an anatomical gift on 19 a hunting, fishing, or fur harvester license with the signed 20 approval of a parent or guardian. 21 Sec. 4. Section 142C.3, subsection 2, paragraph a, Code 22 2019, is amended by adding the following new subparagraph: 23 NEW SUBPARAGRAPH . (02) By authorizing a symbol indicating 24 that the donor has made an anatomical gift to be imprinted on 25 the donor’s hunting, fishing, or fur harvester license. 26 Sec. 5. Section 142C.3, subsection 2, paragraph c, Code 27 2019, is amended to read as follows: 28 c. Revocation, suspension, expiration, or cancellation of a 29 driver’s license , or identification card , or hunting, fishing, 30 or fur harvester license upon which an anatomical gift is 31 indicated shall not invalidate the gift. 32 Sec. 6. Section 142C.8, subsections 1 and 2, Code 2019, are 33 amended to read as follows: 34 1. When a hospital refers an individual at or near death 35 -1- LSB 1049XS (1) 88 js/rn 1/ 4
S.F. 86 to a procurement organization, the procurement organization 1 shall make a reasonable search of the records of the state 2 department of transportation , department of natural resources, 3 and any donor registry that the hospital knows exists for the 4 geographical area in which the individual resides to ascertain 5 whether the individual has made an anatomical gift. 6 2. A procurement organization shall be allowed reasonable 7 access to information in the records of the state department 8 of transportation and the department of natural resources to 9 ascertain whether an individual at or near death is a donor. 10 Sec. 7. Section 142C.18, Code 2019, is amended by adding the 11 following new subsection: 12 NEW SUBSECTION . 2A. The department of natural resources 13 shall cooperate with a person that administers the Iowa donor 14 registry for the purpose of transferring to the donor registry 15 all relevant information regarding a donor’s making of an 16 anatomical gift. 17 Sec. 8. Section 142C.18, subsection 3, paragraph d, Code 18 2019, is amended to read as follows: 19 d. Provide a centralized, automated system to compile 20 donation information received by the state department of 21 transportation, department of natural resources, county 22 treasurers, and the Iowa donor network. 23 Sec. 9. Section 483A.10, Code 2019, is amended by adding the 24 following new subsection: 25 NEW SUBSECTION . 3. An application for a hunting, fishing, 26 or fur harvester license shall include a section where an 27 applicant may request that the applicant’s license include a 28 symbol that indicates that the applicant is a donor under the 29 revised uniform anatomical gift Act as provided in chapter 30 142C. 31 Sec. 10. Section 483A.18, Code 2019, is amended to read as 32 follows: 33 483A.18 Form of licenses. 34 1. All hunting, fishing, and fur harvester licenses shall 35 -2- LSB 1049XS (1) 88 js/rn 2/ 4
S.F. 86 contain a general description of the licensee. Such licenses 1 shall be upon such forms as the commission shall adopt. The 2 address and the signature of the applicant and all signatures 3 and other required information shall be in writing. All 4 licenses shall clearly indicate the nature of the privilege 5 granted. 6 2. Upon request of an applicant pursuant to section 483A.10, 7 the department shall indicate on the license that the applicant 8 is a donor under the revised uniform anatomical gift Act as 9 provided in chapter 142C. 10 Sec. 11. Section 483A.27, subsection 2, paragraph a, Code 11 2019, is amended to read as follows: 12 a. A certificate of completion shall not be issued to 13 a person who has not satisfactorily completed an approved 14 hunter education course. The department shall establish the 15 curriculum based on the standards adopted by the international 16 hunter education association —— United States of America for 17 the approved hunter education course. The curriculum shall 18 include instruction relating to becoming an organ donor under 19 the revised uniform anatomical gift Act as provided in chapter 20 142C. Upon completion of the course, each person shall pass 21 an individual oral test or a written test provided by the 22 department. The department shall establish the criteria for 23 successfully passing the tests. Based on the results of 24 the test and demonstrated safe handling of a firearm, the 25 instructor shall determine the persons who shall be issued a 26 certificate of completion. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 Current law does not require the department of natural 31 resources to include on a hunting, fishing, or fur harvester 32 license application a section where an applicant may request 33 that the applicant’s license indicate that the applicant is 34 a donor under the revised uniform anatomical gift Act. S.F. 86 bill requires the department to include such a section. If 1 any adult applicant or any minor applicant who is at least 2 14 years of age and has the signed approval of a parent or 3 guardian requests that the applicant’s hunting, fishing, or 4 fur harvester license indicate that the applicant is a donor 5 under the revised uniform anatomical gift Act, the department 6 must place a symbol on the applicant’s license that makes the 7 indication. An applicant’s authorization to have the symbol 8 placed on the applicant’s hunting, fishing, or fur harvester 9 license is a valid method of making an anatomical gift under 10 the bill. 11 The bill requires the department to provide reasonable 12 access to information to a procurement organization to 13 ascertain whether an individual at or near death is a donor. 14 The bill also requires the department to cooperate with a 15 person that administers the Iowa donor registry for the purpose 16 of transferring to the registry all relevant information 17 regarding a donor’s making of an anatomical gift. The 18 department shall also include instruction relating to becoming 19 an organ donor under the revised uniform anatomical gift Act in 20 its hunter education program curriculum. 21 -4- LSB 1049XS (1) 88 js/rn 4/ 4
