to

as

practice

massage
therapy
as
defined
in
section

is
strictly
prohibited
by
unlicensed
individuals.
It

is
unlawful
a
serious
misdemeanor
for
a
person
to
engage
in
or

offer
to
engage
in
the
practice
of
massage
therapy,
or
use
in
7
connection
with
the
person’s
name,
the
initials
“L.
M.
T.”
or
8
the
words
“licensed
massage
therapist”,
“massage
therapist”,
9
“masseur”,
“masseuse”,
or
any
other
word
or
title
that
implies
10
or
represents
that
the
person
practices
massage
therapy,
unless
11
the
person
possesses
a
license
issued
under
the
provisions
of
12
section
152C.3
.

NEW
SECTION
.
152C.10
Enforcement.
14
A
political
subdivision
of
the
state
shall
not
enact
or
15
enforce
any
restrictions
or
requirements
concerning
massage
16
therapists
and
the
practice
of
massage
therapy
that
are
17
inconsistent
with
the
provisions
of
this
chapter.

EXPLANATION
19
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
20
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
makes
the
practice
of
massage
therapy
or
the
use
22
of
titles
associated
with
massage
therapists
by
an
unlicensed
23
individual
a
serious
misdemeanor.
A
serious
misdemeanor
is
24
punishable
by
confinement
for
no
more
than
one
year
and
a
fine
25
of
at
least
$315
but
not
more
than
$1,875.
The
bill
also
26
prohibits
political
subdivisions
of
the
state
from
enacting
or
27
enforcing
restrictions
on
massage
therapy
or
massage
therapists
28
that
are
not
contained
in
Code
chapter
152C.
