Bill Title: Amends the Township Code. Provides that all townships within a coterminous, or substantially coterminous, municipality may be discontinued (currently, municipalities in which the city council exercises the powers and duties of the township board, or in which one or more municipal officials serve as an officer or trustee of the township; that are located within a county with a population of 3 million or more; and which contain a territory of 7 square miles or more). Makes conforming changes. Repeals an Article of the Township Code regarding discontinuance of specified townships in St. Clair County. Effective immediately.

2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Township Code is amended by changing
5Sections 27-5 and 27-10 and the heading of Article 27 as
6follows:

13 Sec. 27-5. Applicability. This Article shall apply only to
14a township that: (1) is within a coterminous, or substantially
15coterminous, municipality in which the city council exercises
16the powers and duties of the township board, or in which one or
17more municipal officials serve as an officer or trustee of the
18township; (2) is located within a county with a population of 3
19million or more; and (3) contains a territory of 7 square miles
20or more.

2 Sec. 27-10. Petition and referendum to discontinue and
3abolish a township organization within a coterminous
4municipality. Upon adoption of an ordinance by the township
5board or the city council of a municipality in which the city
6council exercises the powers and duties of the township board
7city council of a township described under Section 27-5 of this
8Article, or upon petition of at least 10% of the registered
9voters of that township, the township board or the city council
10shall certify and cause to be submitted to the voters of the
11township, at the next election or consolidated election, a
12proposition to discontinue and abolish the township
13organization and to transfer all the rights, powers, duties,
14assets, property, liabilities, obligations, and
15responsibilities of the township organization to the
16coterminous municipality.
17 A signature on a petition shall not be valid or counted in
18considering the petition unless the form requirements are
19complied with and the date of each signature is less than 90
20days before the last day for filing the petition. The statement
21of the person who circulates the petition must include an
22attestation (i) indicating the dates on which that sheet was
23circulated, (ii) indicating the first and last date on which
24that sheet was circulated, or (iii) certifying that none of the
25signatures on the sheet was signed more than 90 days before the
26last day for filing the petition. The petition shall be treated

1and the proposition certified in the manner provided by the
2general election law. After the proposition has once been
3submitted to the electorate, the proposition shall not be
4resubmitted for 4 years.
5 The proposition shall be in substantially the following
6form:
7 Shall the township organization be continued in [Name
8 of Township] Township?
9 The votes shall be recorded as "Yes" or "No".

12 Section 10. The Township Code is amended by repealing
13Article 28.
14 Section 99. Effective date. This Act takes effect upon
15becoming law.
