Bill Title: Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that beginning no later than October 1, 2019, and for each State fiscal year thereafter, the monthly personal needs allowance required under Title XIX of the Social Security Act for any person residing in a facility licensed under the Community-Integrated Living Arrangements Licensure and Certification Act who is determined to be eligible for medical assistance under the Code and who is enrolled in the State's Home and Community-Based Services Waiver Program for adults with developmental disabilities shall be no less than 15% of the individual's monthly Supplemental Security Income benefits or Social Security Disability Insurance benefits, or both, for the previous calendar year. Establishes a similar personal needs allowance amount for any person residing in a facility licensed under the ID/DD Community Care Act who is determined to be eligible for medical assistance under the Code beginning no later than October 1, 2019 and for each State fiscal year thereafter. Effective immediately.

305 ILCS 5/5-36 new

Amends the Medical Assistance Article of the Illinois Public Aid Code. 2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Public Aid Code is amended by
5adding Section 5-36 as follows:
6 (305 ILCS 5/5-36 new)
7 Sec. 5-36. Personal needs allowance; Community-Integrated
8Living Arrangements; ID/DD facilities.
9 (a) Beginning no later than October 1, 2019, and for each
10State fiscal year thereafter, the monthly personal needs
11allowance required under Section 1902(q) of Title XIX of the
12Social Security Act (42 U.S.C. 1396a(q)) for any person
13residing in a facility licensed under the Community-Integrated
14Living Arrangements Licensure and Certification Act who is
15determined to be eligible for medical assistance under this
16Code and who is enrolled in the State's Home and
17Community-Based Services Waiver Program for adults with
18developmental disabilities shall be no less than 15% of the
19individual's monthly Supplemental Security Income benefits or
20Social Security Disability Insurance benefits, or both, for the
21previous calendar year.
22 (b) Beginning no later than October 1, 2019, and for each
23State fiscal year thereafter, the monthly personal needs
