Bill Title: Authorizes the Department of Human Services to grant and convey a permanent conservation easement to the Chicago Park District. Repeals a provision in Public Act 94-653 regarding the legal description of the land. Authorizes the Director of the Department of Natural Resources to terminate all contractual interests of the State of Illinois provided in the agreement between the State and the City of Pana, made on June 28, 1949, for the purpose of funding the construction of a dam and water reservoir to create the Pana Lake Project. Provides that the State of Illinois shall not receive compensation for the termination of its contractual rights. Provides that the Director shall execute a mutual termination with the City of Pana terminating both parties' interests in the agreement. Authorizes the Director to execute and deliver a quitclaim deed concerning specified real property to the Forest Preserve District of Will County for $1. Authorizes and directs the Illinois Medical District Commission to execute and deliver a quitclaim deed for specified real property to the Julie and Michael Tracy Family Foundation. Effective immediately.

1 AN ACT concerning civil law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:

ARTICLE 1.
5 Section 1-5. "AN ACT concerning civil law", approved August
622, 2005, Public Act 94-653, is amended by changing Section 5
7as follows:
8 (P.A. 94-653, Sec. 5)
9 Sec. 5. The Illinois Department of Human Services is hereby
10authorized to grant and convey a permanent conservation
11easement to the Illinois Department of Natural Resources or to
12the Chicago Park District on a parcel containing 30 acres, more
13or less, that is located in Section 18, Township 40 North,
14Range 13 East of the third principal meridian, Cook County,
15Illinois, situated to the West and South of the Chicago Read
16Mental Health Center, for the purpose of preserving and
17protecting the wetlands and forested area for the benefit of
18the patients of the facility, the community, and the general
19public, this 30-acre parcel being more particularly described
20under Section 10 of this Act.

3August 22, 2005, Public Act 94-653, is amended by repealing
4Section 10.

ARTICLE 2.
6 Section 2-5. The Director of the Department of Natural
7Resources, on behalf of the State of Illinois, is authorized to
8terminate all contractual interests of the State of Illinois
9provided in the Agreement between the State of Illinois,
10through the former Department of Conservation, and the City of
11Pana, a Municipal Corporation, situated in Christian County,
12made on June 28, 1949, for the purpose of funding the
13construction of a dam and water reservoir to create the Pana
14Lake Project.
15 Section 2-10. The State of Illinois contractual interests
16authorized to be terminated by this Act include the following:
17 (1) Rights to develop, manage, and maintain any and all of
18the lands associated with the Pana Lake Project, as described
19in Exhibit A of the Agreement, as part of a Statewide lake,
20water storage, and public recreation system, including public
21hunting and fishing grounds development of game management and
22reforestation and to use said area for the preservation and
23propagation of fish and wildlife thereon for 99 years.

1 (2) Obligation of the City of Pana to maintain the Pana
2Lake Project at its own sole cost and expense and keep in good
3repair at all times the dam and all facilities erected in
4connection therewith.
5 (3) Right to purchase the land occupied by the Pana Lake
6Project if the City of Pana shall at any time determine to sell
7such land and the improvements thereon.
8 Section 2-15. The State of Illinois paid $100,000 toward
9the Pana Lake Project in consideration for obtaining the
10foregoing contractual interests pursuant to appropriation of
11State funds for the purpose made in Section 4 of Senate Bill
12662 by the 65th General Assembly, approved July 21, 1947.
13 Section 2-20. The State of Illinois shall not receive
14consideration for the termination of its contractual rights of
15the June 28, 1949 Agreement.
16 Section 2-25. The Director of the Department of Natural
17Resources may execute a mutual termination with the City of
18Pana terminating both parties' interests in the June 28, 1949
19Agreement.

3 Section 4-15. The President of the Illinois Medical
4District Commission shall obtain a certified copy of the
5portions of this Act containing the title, the enacting clause,
6the effective date, the appropriate Section or Sections
7containing the land descriptions of the property to be
8conveyed, and this Section within 60 days after its effective
9date and shall record the certified document in the Recorder's
10office in the county in which the land is located.

ARTICLE 99.
12 Section 99-99. Effective date. This Act takes effect upon
13becoming law.
