Bill Title: Amends the Liquor Control Act of 1934. Provides that a vote to prohibit sales at retail of alcoholic liquor (or alcoholic liquor other than beer containing not more than 4% of alcohol by weight or alcoholic liquor containing more than 4% alcohol by weight in the original package and not for consumption on the premises) in a precinct in a city, village, or incorporated town of more than 200,000 inhabitants shall not apply to retail sales of alcoholic liquor by a specific private institution of higher learning or an affiliate thereof.

1 | AN ACT concerning liquor.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Liquor Control Act of 1934 is amended by | |||||||||||||||||||
5 | adding Section 9-2d as follows:
| |||||||||||||||||||
6 | (235 ILCS 5/9-2d new) | |||||||||||||||||||
7 | Sec. 9-2d. Private institution of higher learning. Any vote | |||||||||||||||||||
8 | under this Article, whenever held, to prohibit sales at retail | |||||||||||||||||||
9 | of alcoholic liquor (or alcoholic liquor other than beer | |||||||||||||||||||
10 | containing not more than 4% of alcohol by weight or alcoholic | |||||||||||||||||||
11 | liquor containing more than 4% alcohol by
weight in the | |||||||||||||||||||
12 | original package and not for consumption on the premises) in a | |||||||||||||||||||
13 | precinct in a city, village, or incorporated town of more than | |||||||||||||||||||
14 | 200,000 inhabitants shall not apply to retail sales of | |||||||||||||||||||
15 | alcoholic liquor if: | |||||||||||||||||||
16 | (1) the alcoholic liquor is sold on property owned by a | |||||||||||||||||||
17 | private institution of higher learning or an affiliate | |||||||||||||||||||
18 | thereof that is bounded by the south side of 60th Street on | |||||||||||||||||||
19 | the north, the west side of Kimbark Avenue to the east, the | |||||||||||||||||||
20 | north side of 61st Street to the south, and the east side | |||||||||||||||||||
21 | of Woodlawn Avenue to the west in the City of Chicago; | |||||||||||||||||||
22 | (2) the alcoholic liquor is sold by a private | |||||||||||||||||||
23 | institution of higher learning or an affiliate thereof, by |

| |||||||
1 | a person who leases the property owned by the private | ||||||
2 | institution of higher learning or an affiliate thereof, or | ||||||
3 | by a person contractually authorized to sell alcoholic | ||||||
4 | liquor on the premises; | ||||||
5 | (3) the person conducting the retail sale of alcoholic | ||||||
6 | liquor obtains all of the necessary local and State | ||||||
7 | licenses authorizing the retail sale of alcoholic liquor; | ||||||
8 | and | ||||||
9 | (4) the sale of alcoholic liquor is not the principal | ||||||
10 | business to be carried on by the license holder.
