1 | AN ACT concerning civil law.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Code of Civil Procedure is amended by | |||||||||||||||||||
5 | changing Section 13-214.1 as follows:

6 | (735 ILCS 5/13-214.1) (from Ch. 110, par. 13-214.1)
| |||||||||||||||||||
7 | Sec. 13-214.1. Action for damages involving criminal
acts. | |||||||||||||||||||
8 | (a) Actions for damages for an injury described in Section | |||||||||||||||||||
9 | 13-202
or Section 13-203 arising out of first degree murder or | |||||||||||||||||||
10 | the commission of
a Class X felony
by the person against whom | |||||||||||||||||||
11 | the action is brought may be commenced no later
than 10 years | |||||||||||||||||||
12 | after the person who inflicted such injury has completed his
or | |||||||||||||||||||
13 | her sentence therefor.

14 | (b) For an action for damages arising out of: theft of | |||||||||||||||||||
15 | property exceeding $100,000 in value under Section 16-1 of the | |||||||||||||||||||
16 | Criminal Code of 2012; identity theft under subsection (a) of | |||||||||||||||||||
17 | Section 16-30 of the Criminal Code of 2012; aggravated identity | |||||||||||||||||||
18 | theft under subsection (b) of Section 16-30 of the Criminal | |||||||||||||||||||
19 | Code of 2012; financial exploitation of an elderly person or a | |||||||||||||||||||
20 | person with a disability under Section 17-56 of the Criminal | |||||||||||||||||||
21 | Code of 2012; or any offense set forth in Article 16H or | |||||||||||||||||||
22 | Section 17-10.6 of the Criminal Code of 2012, the action may be | |||||||||||||||||||
23 | commenced within 10 years of the last act committed in |

1 | furtherance of the crime. However, if any other provision of | ||||||
2 | law provides for a longer limitation period, then the longer | ||||||
3 | limitation period applies. This subsection applies to causes of | ||||||
4 | action accruing on or after July 1, 2009. | ||||||
