1 AN ACT concerning animals.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Humane Care for Animals Act is amended by
5changing Section 7.15 and by adding Section 2.01i as follows:
6 (510 ILCS 70/2.01i new)
7 Sec. 2.01i. Assistance animal. "Assistance animal" means
8an animal trained by a licensed or certified person,
9organization, or agency to assist a person who has a physical,
10sensory, intellectual, developmental, psychiatric, or mental
11disability in one or more daily life activities. "Assistance
12animal" includes guide dogs, leader dogs, hearing ear dogs, and
13any animal trained to do work or perform tasks for the benefit
14of a person with a disability, including, but not limited to:
15 (1) pulling a wheelchair;
16 (2) providing balance or stability support;
17 (3) retrieving objects; and
18 (4) providing assistance and support during a medical,
19 psychological, or emotional crisis.

21 Sec. 7.15. Assistance animal Guide, hearing, and support
22dogs.

1 (a) A person may not willfully and maliciously annoy,
2taunt, tease, harass, torment, beat, or strike an assistance
3animal a guide, hearing, or support dog or otherwise engage in
4any conduct directed toward an assistance animal a guide,
5hearing, or support dog that is likely to impede or interfere
6with the assistance animal's dog's performance of its duties or
7that places the blind, hearing impaired, or person with a
8physical disability being served or assisted by the assistance
9animal dog in danger of injury.
10 (b) A person may not willfully and maliciously torture,
11injure, or kill an assistance animal a guide, hearing, or
12support dog.
13 (c) A person may not willfully and maliciously permit an
14animal a dog that is owned, harbored, or controlled by the
15person to cause injury to or the death of an assistance animal
16a guide, hearing, or support dog while the assistance animal
17guide, hearing, or support dog is in discharge of its duties.
18 (d) A person convicted of violating this Section is guilty
19of a Class A misdemeanor. A second or subsequent violation is a
20Class 4 felony. A person convicted of violating subsection (b)
21or (c) of this Section is guilty of a Class 4 felony if the
22assistance animal dog is killed or totally disabled, and may be
23ordered by the court to make restitution to the person with a
24disability having custody or ownership of the assistance animal
25dog for veterinary bills and replacement costs of the
26assistance animal dog.
