Bill Title: Amends the Voluntary Health Services Plans Act. Provides that if a health services plan corporation furnishes dental services to the plan's subscribers and beneficiaries and these services are rendered by dentists licensed in Illinois, the board of trustees of the corporation shall appoint a Dental Director who shall be a dentist licensed to practice dentistry in Illinois. Provides that the Dental Director, under the board of trustees, shall have control of and responsibility for the dental and dental-related scientific aspects of the business of the corporation. Effective immediately.

Amends the Voluntary Health Services Plans Act. Provides that if a health services plan corporation furnishes dental services to the plan's subscribers and beneficiaries and these services are rendered by dentists licensed in Illinois, the board of trustees of the corporation shall appoint a Dental Director who shall be a dentist licensed to practice dentistry in Illinois. Provides that the Dental Director, under the board of trustees, shall have control of and responsibility for the dental and dental-related scientific aspects of the business of the corporation. 1 AN ACT concerning regulation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Voluntary Health Services Plans Act is
5amended by changing Section 5 as follows:
6 (215 ILCS 165/5) (from Ch. 32, par. 599)
7 Sec. 5. The business and affairs of a health services plan
8corporation shall be managed by a board of trustees, which
9shall have the power to adopt, and to amend from time to time,
10by-laws governing the conduct of the corporation's business.
11The board of trustees shall consist of not less than seven
12persons, all of whom shall have the same general qualifications
13as the incorporators, and at least 30% of whom shall, in
14addition, be physicians or dentists, licensed in Illinois to
15practice medicine in all of its branches or dentistry,
16respectively; provided, however, that if in computing the
17required number of physicians or dentists on the board of
18trustees, the amount of 30% does not coincide with a whole
19number, but lies between whole numbers, the smaller whole
20number shall be controlling as to the number of physicians or
21dentists. The original board of trustees shall be appointed by
22the incorporators. Trustees shall serve for a term of three
23years, except that as to the original appointed board, not more

1than one-third of the members thereof shall be appointed for
2three years, not more than one-third thereof for two years and
3the balance thereof for one year. As the terms of the members
4of the board of trustees expire, they shall be replaced, from
5time to time, by election by the health services plan
6subscribers who are members of the health services plan
7corporation. If the corporation furnishes medical services to
8the plan's subscribers and beneficiaries and these services are
9rendered by physicians licensed in Illinois to practice
10medicine in all of its branches, the board of trustees shall
11appoint a Medical Director who shall be a physician licensed in
12Illinois to practice medicine in all of its branches. The
13Medical Director may participate in all deliberations of the
14board of trustees but shall not vote in any decisions or
15determinations made by the board of trustees. The Medical
16Director, under the board of trustees, shall have complete
17charge of and responsibility for the medical and medically
18related scientific aspects of the business of the corporation.
19If the corporation furnishes dental services to the plan's
20subscribers and beneficiaries and these services are rendered
21by dentists licensed in Illinois, the board of trustees shall
22appoint a Dental Director who shall be a dentist licensed in
23Illinois to practice dentistry. The Dental Director may
24participate in all deliberations of the board of trustees but
25shall not vote in any decisions or determinations made by the
26board of trustees. The Dental Director, under the board of
