1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended by
5adding Section 40.4 as follows:
6 (415 ILCS 5/40.4 new)
7 Sec. 40.4. Environmental justice program.
8 (a) The General Assembly finds that:
9 (1) People in Illinois should receive notice of and be
10 provided an opportunity to comment on proposed permitting
11 actions by the Agency.
12 (2) The Agency should facilitate public participation
13 and access to information during permitting.
14 (3) The Agency should accept public comments during the
15 permitting process.
16 (4) The Agency should give consideration to public
17 comments in a manner consistent with the Agency's authority
18 and the applicable State and federal laws and regulations
19 concerning the protection of air, water, and land.
20 (b) An environmental justice program is created to ensure
21enhanced public outreach procedures for permitting actions
22that affect areas of environmental justice concern.
23 (c) Within one year of the effective date of this

1amendatory Act of the 101st General Assembly, the Agency shall
2adopt rules implementing subsection (b) that are consistent
3with the findings in subsection (a).
4 Section 99. Effective date. This Act takes effect upon
5becoming law.
