1 AN ACT concerning finance.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Business Enterprise for Minorities, Women,
5and Persons with Disabilities Act is amended by changing
6Section 8j and by adding Section 8k as follows:
7 (30 ILCS 575/8j)
8 (Section scheduled to be repealed on June 30, 2024)
9 Sec. 8j. Special Committee on Minority, Female, Persons
10with Disabilities, and Veterans Contracting.
11 (a) There is created a Special Committee on Minority,
12Female, Persons with Disabilities, and Veterans Contracting
13under the Council. The Special Committee shall review Illinois'
14procurement laws regarding contracting with minority-owned
15businesses, women-owned businesses, businesses owned by
16persons with disabilities, and veteran-owned businesses to
17determine what changes should be made to increase participation
18of these businesses in State procurements.
19 (b) The Special Committee shall consist of the following
20members:
21 (1) 3 persons each to be appointed by the Speaker of
22 the House of Representatives, the Minority Leader of the
23 House of Representatives, the President of the Senate, and

1 the Minority Leader of the Senate; only one Special
2 Committee member of each appointee under this paragraph may
3 be a current member of the General Assembly;
4 (2) the Director of Central Management Services, or his
5 or her designee;
6 (3) the chairperson of the Council, or his or her
7 designee; and
8 (4) each chief procurement officer.
9 (c) The Special Committee shall conduct at least 3
10hearings, with at least one hearing in Springfield and one in
11Chicago. Each hearing shall be open to the public and notice of
12the hearings shall be posted on the websites of the Procurement
13Policy Board, the Department of Central Management Services,
14and the General Assembly at least 6 days prior to the hearing.
15 (d) The Special Committee is dissolved, and this Section is
16repealed on the effective date of this amendatory Act of the
17101st General Assembly.

20 Sec. 8k. Task Force on Equity in State Contracting.
21 (a) The Task Force on Equity in State Contracting is
22created to study the effectiveness of State programs created to
23empower minority-owned businesses, women-owned businesses,
24businesses owned by persons with disabilities, and
25veteran-owned businesses through equity in State contracting

1with analysis of statutory provisions, including, but not
2limited to, the requirements of this Act and the Illinois
3Procurement Code.
4 (b) The Task Force shall include the following members:
5 (1) one member to serve as Chair, appointed by the
6 Governor;
7 (2) the Director of Central Management Services, or his
8 or her designee;
9 (3) the chair of the Business Enterprise for
10 Minorities, Women, and Persons with Disabilities Council,
11 or his or her designee;
12 (4) the Chief Procurement Officer for the Department of
13 Transportation, or his or her designee;
14 (5) the Chief Procurement Officer for General
15 Services, or his or her designee;
16 (6) the Chief Procurement Officer for the Capital
17 Development Board, or his or her designee;
18 (7)_ the Chief Procurement Officer for Higher
19 Education, or his or her designee;
20 (8) the Executive Director of the Executive Ethics
21 Commission, or his or her designee;
22 (9) one member appointed by the Attorney General;
23 (10) two members of the House of Representatives,
24 appointed by the Speaker of the House of Representatives;
25 (11) two members of the House of Representatives,
26 appointed by the Minority Leader of the House of

1 Representatives;
2 (12) two members of the Senate, appointed by the
3 President of the Senate; and
4 (13) two members of the Senate, appointed by the
5 Minority Leader of the Senate.
6 (c) Each member of the Task Force shall serve without
7compensation. The Task Force shall meet publicly at least 4
8times at the call of the Chair. The Department of Central
9Management Services shall provide administrative support for
10the Task Force.
11 (d) The Task Force shall submit a report to the Governor
12and the General Assembly on or before January 13, 2021
13outlining:
14 (1) recent changes in State law to increase equity in
15 State contracting;
16 (2) the current status of implementation and
17 enforcement of these changes, including their
18 effectiveness and challenges; and
19 (3) recommendations, both legislative and
20 non-legislative, to increase the effectiveness of State
21 investment to empower minority-owned businesses,
22 women-owned businesses, businesses owned by persons with
23 disabilities, and veteran-owned businesses, and ensure
24 transparency and ethical contracting.
25 (e) This Section is repealed on January 1, 2022.
