Bill Title: Amends the Criminal Code of 2012. Creates the offense of unlawful possession of a firearm in a motor vehicle with unlawfully tinted windows. Provides that a person commits the offense when he or she knowingly: (1) possesses or carries in any vehicle a firearm and firearm ammunition which are both immediately accessible at the time of the offense while on any street, road, alley, or any other lands, except when inside his or her own abode or garage, and has not been issued a currently valid Firearm Owner's Identification Card; and (2) the vehicle in which the person is present is fitted with window treatments or tinting of the windshield or windows, or both, immediately adjacent to each side of the driver, in violation of the Illinois Vehicle Code. Provides that a violation is a Class 2 felony.

SYNOPSIS AS INTRODUCED:
720 ILCS 5/24-1.9 new

Amends the Criminal Code of 2012. Creates the offense of unlawful possession of a firearm in a motor vehicle with unlawfully tinted windows. 2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Criminal Code of 2012 is amended by adding
5Section 24-1.9 as follows:
6 (720 ILCS 5/24-1.9 new)
7 Sec. 24-1.9. Unlawful possession of a firearm in a motor
8vehicle with unlawfully tinted windows.
9 (a) A person commits unlawful possession of a firearm in a
10motor vehicle with unlawfully tinted windows when he or she
11knowingly:
12 (1) possesses or carries in any vehicle a firearm and
13 firearm ammunition which are both immediately accessible
14 at the time of the offense while on any street, road,
15 alley, or any other lands, except when inside his or her
16 own abode or garage, and has not been issued a currently
17 valid Firearm Owner's Identification Card; and
18 (2) the vehicle in which the person is present is
19 fitted with window treatments or tinting of the windshield
20 or windows, or both, immediately adjacent to each side of
21 the driver, in violation of subsection (a) or (a-5) of
22 Section 12-503 of the Illinois Vehicle Code.
