Bill Title: Amends the Mental Health and Developmental Disabilities Code. Provides that no adult person who is diagnosed as a person with an intellectual disability or a person with a developmental disability may be discharged from a hospital, or similar facility, and transferred to a mental health facility, or any portion thereof, without first notifying a parent or guardian of that individual.

SYNOPSIS AS INTRODUCED:
405 ILCS 5/3-200.5 new

Amends the Mental Health and Developmental Disabilities Code. Provides that no adult person who is diagnosed as a person with an intellectual disability or a person with a developmental disability may be discharged from a hospital, or similar facility, and transferred to a mental health facility, or any portion thereof, without first notifying a parent or guardian of that individual.

1 AN ACT concerning health.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Mental Health and Developmental
5Disabilities Code is amended by adding Section 3-200.5 as
6follows:
7 (405 ILCS 5/3-200.5 new)
8 Sec. 3-200.5. Notice of adult involuntary transfer. No
9adult person who is diagnosed as a person with an intellectual
10disability or a person with a developmental disability may be
11discharged from a hospital, or similar facility, and
12transferred to a mental health facility, or any portion
13thereof, without first notifying a parent or guardian of that
14individual.
