1 | HOUSE RESOLUTION
| ||||||
2 | WHEREAS, The U.S. Congress passed into law the National | ||||||
3 | Childhood Vaccine Injury Act of 1986,
which states that no | ||||||
4 | "vaccine manufacturer shall be liable in a civil action for | ||||||
5 | damages arising
from a vaccine-related injury or death | ||||||
6 | associated with the administration of a vaccine after
October | ||||||
7 | 1, 1988, if the injury or death resulted from side effects that | ||||||
8 | were unavoidable even
though the vaccine was properly prepared | ||||||
9 | and was accompanied by proper directions and
warnings"; and

10 | WHEREAS, In 2011, the United States Supreme Court ruled in | ||||||
11 | Bruesewitz v. Wyeth that the
"National Childhood Vaccine Injury | ||||||
12 | Act pre-empts all design-defect claims against vaccine
| ||||||
13 | manufacturers brought by plaintiffs who seek compensation for | ||||||
14 | injury or death caused by
vaccine side effects"; and
| ||||||
15 | WHEREAS, Our individual human rights should outweigh the | ||||||
16 | profits of pharmaceutical
companies, and individuals should | ||||||
17 | have the ability to hold vaccine manufacturers liable for
| ||||||
18 | design defects that result in adverse side effects from | ||||||
19 | vaccines; and
| ||||||
20 | WHEREAS, The European Union has found a way to allow | ||||||
21 | evidence-based lawsuits to hold
vaccine manufacturers liable | ||||||
22 | without destabilizing the European health care system; |

2 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE | ||||||
3 | HUNDRED FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that | ||||||
4 | we urge the
Congress of the United States to pass, and the | ||||||
5 | President to sign, legislation removing 42 U.S.C.
| ||||||
6 | 300aa-22(b)(1) from law and allowing design defect claims | ||||||
7 | against vaccine manufacturers by
individuals who have | ||||||
8 | experienced adverse side effects caused by vaccines; and be it | ||||||
9 | further
| ||||||
10 | RESOLVED, That suitable copies of this resolution be | ||||||
11 | delivered to the President of the United States, the U.S. | ||||||
12 | Senate Majority Leader, the U.S. Speaker of the House of | ||||||
13 | Representatives, each member of
the Illinois Congressional | ||||||
14 | Delegation, and the U.S. Secretary of Health and Human

15 | Services.
