Bill Title: Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department of Public Health shall develop and make available training materials that ensure that all phlebotomists are trained in the most current methods of drawing blood from children and adults with intellectual and developmental disabilities. Provides that the materials shall conform to the best available practices used for drawing blood in a safe manner that is as comfortable as possible for the individual from whom blood is drawn and for the families, guardians, caretakers, or companions of the individual accompanying him or her while blood is drawn. Provides that the Department shall review the materials every 3 years to ensure that they conform with the best available practices. Provides that the Department shall ensure that health care providers and laboratories that employ a phlebotomist incorporate the training as part of a phlebotomist's initial employment training and as part of any ongoing training to maintain competencies and certifications as a phlebotomist. Defines "phlebotomist".

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Department of Public Health Powers and | ||||||||||||||||||||||||
5 | Duties Law of the
Civil Administrative Code of Illinois is | ||||||||||||||||||||||||
6 | amended by adding Section 2310-218 as follows:

7 | (20 ILCS 2310/2310-218 new) | ||||||||||||||||||||||||
8 | Sec. 2310-218. Phlebotomy on children and adults with | ||||||||||||||||||||||||
9 | intellectual and developmental disabilities. | ||||||||||||||||||||||||
10 | (a) As used in this Section, "phlebotomist" means a person | ||||||||||||||||||||||||
11 | who draws blood for diagnostic testing, transfusions, | ||||||||||||||||||||||||
12 | research, or blood donations. | ||||||||||||||||||||||||
13 | (b) The Department shall ensure that all phlebotomists are | ||||||||||||||||||||||||
14 | trained in the most current methods of drawing blood from | ||||||||||||||||||||||||
15 | children and adults with intellectual and developmental | ||||||||||||||||||||||||
16 | disabilities. The training shall focus on drawing blood in a | ||||||||||||||||||||||||
17 | safe manner that is as comfortable as possible for the | ||||||||||||||||||||||||
18 | individual from whom blood is drawn and for the families, | ||||||||||||||||||||||||
19 | guardians, caretakers, or companions of the individual | ||||||||||||||||||||||||
20 | accompanying him or her while blood is drawn. Such training | ||||||||||||||||||||||||
21 | shall occur at least every 3 years. | ||||||||||||||||||||||||
22 | (c) The Department shall ensure that all persons and | ||||||||||||||||||||||||
23 | entities that perform the training described in subsection (b) |

1 | review their training program not less than once every 3 years | ||||||
2 | to determine how their program conforms to the best available | ||||||
3 | practices used to safely draw blood from children and adults | ||||||
4 | with intellectual and developmental disabilities in a manner | ||||||
5 | that is as comfortable as possible for the individual from whom | ||||||
6 | blood is drawn and for the families, guardians, caretakers, or | ||||||
7 | companions of the individual accompanying him or her while | ||||||
8 | blood is drawn. | ||||||
9 | (d) The Department shall ensure that all licensed medical | ||||||
10 | facilities, including, but not limited to, hospitals, | ||||||
11 | pediatric care facilities, and adult care facilities, are, at a | ||||||
12 | minimum, equipped to draw blood from children and adults with | ||||||
13 | intellectual and developmental disabilities using finger-prick | ||||||
14 | equipment, hemoglobin testing equipment, and all other related | ||||||
15 | equipment that can be adapted to serve patients with | ||||||
16 | intellectual and developmental disabilities. The Department | ||||||
17 | shall ensure that all licensed medical facilities comply with | ||||||
18 | this subsection by July 1, 2020.
