Bill Title: Amends the School Code. Provides that, upon knowledge of an incident of sexual assault by a student against another student, a school district shall report the incident to the State Board of Education; defines "sexual assault". Provides that the State Board shall post on its website for each school year the total number of reported incidents statewide and in each school district. Provides that the State Board shall also report the data annually to the General Assembly no later than September 1 of each year.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The School Code is amended by adding Sections
52-3.176, 10-20.69, and 34-18.61 as follows:
6 (105 ILCS 5/2-3.176 new)
7 Sec. 2-3.176. Sexual assault data. The State Board of
8Education shall post on its website for each school year the
9total number of incidents reported under Sections 10-20.69 and
1034-18.61 of this Code statewide and in each school district.
11The State Board shall also report the data annually to the
12General Assembly no later than September 1 of each year.

14 Sec. 10-20.69. Attacks on students; sexual assault.
15 (a) In this Section, "sexual assault" means any act of
16nonconsensual sexual conduct or sexual penetration, as defined
17under Section 11-0.1 of the Criminal Code of 2012, including,
18but not limited to, acts prohibited under Sections 11-1.20
19through 11-1.60 of the Criminal Code of 2012.
20 (b) Upon knowledge of an incident of sexual assault by a
21student against another student, a school district shall report
22the incident to the State Board of Education.

3 (a) In this Section, "sexual assault" means any act of

6but not limited to, acts prohibited under Sections 11-1.20
7through 11-1.60 of the Criminal Code of 2012.
