Bill Title: Amends the Department of State Police Law of the Civil Administrative Code of Illinois. Provides that the Office of the Director of State Police (rather than the Division of Administration) shall: (1) exercise the rights, powers, and duties vested in the Department of State Police by the Governor's Office of Management and Budget Act; (2) exercise the rights, powers, and duties vested in the Department by the Personnel Code; and (3) exercise the rights, powers, and duties vested in the Department by the Fiscal Control and Internal Auditing Act. Changes the Division of Administration to the Division of Justice Services. Provides that the Division of Justice Services (rather than the Division of Forensic Services) shall exercise the rights, powers, and duties vested by law in the Department by the Criminal Identification Act.

1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Department of State Police Law of the Civil
5Administrative Code of Illinois is amended by changing Sections
62605-25, 2605-40, and 2605-45 as follows:
7 (20 ILCS 2605/2605-25) (was 20 ILCS 2605/55a-1)
8 Sec. 2605-25. Department divisions.
9 (a) The Department is divided into the Illinois State
10Police Academy, the Office of the Statewide 9-1-1
11Administrator, and 4 divisions: the Division of Operations, the
12Division of Forensic Services, the Division of Justice Services
13Administration, and the Division of Internal Investigation.
14 (b) The Office of the Director shall:
15 (1) Exercise the rights, powers, and duties vested in
16 the Department by the Governor's Office of Management and
17 Budget Act.
18 (2) Exercise the rights, powers, and duties vested in
19 the Department by the Personnel Code.
20 (3) Exercise the rights, powers, and duties vested in
21 the Department by "An Act relating to internal auditing in
22 State government", approved August 11, 1967 (repealed; now
23 the Fiscal Control and Internal Auditing Act).

3 Sec. 2605-40. Division of Forensic Services. The Division
4of Forensic Services shall exercise the following functions:
5 (1) (Blank). Exercise the rights, powers, and duties
6 vested by law in the Department by the Criminal
7 Identification Act.
8 (2) Exercise the rights, powers, and duties vested by
9 law in the Department by Section 2605-300 of this Law.
10 (3) Provide assistance to local law enforcement
11 agencies through training, management, and consultant
12 services.
13 (4) (Blank).
14 (5) Exercise other duties that may be assigned by the
15 Director in order to fulfill the responsibilities and
16 achieve the purposes of the Department.
17 (6) Establish and operate a forensic science
18 laboratory system, including a forensic toxicological
19 laboratory service, for the purpose of testing specimens
20 submitted by coroners and other law enforcement officers in
21 their efforts to determine whether alcohol, drugs, or
22 poisonous or other toxic substances have been involved in
23 deaths, accidents, or illness. Forensic toxicological
24 laboratories shall be established in Springfield, Chicago,
25 and elsewhere in the State as needed.

1 (6.5) Establish administrative rules in order to set
2 forth standardized requirements for the disclosure of
3 toxicology results and other relevant documents related to
4 a toxicological analysis. These administrative rules are
5 to be adopted to produce uniform and sufficient information
6 to allow a proper, well-informed determination of the
7 admissibility of toxicology evidence and to ensure that
8 this evidence is presented competently. These
9 administrative rules are designed to provide a minimum
10 standard for compliance of toxicology evidence and is not
11 intended to limit the production and discovery of material
12 information. These administrative rules shall be submitted
13 by the Department of State Police into the rulemaking
14 process under the Illinois Administrative Procedure Act on
15 or before June 30, 2017.
16 (7) Subject to specific appropriations made for these
17 purposes, establish and coordinate a system for providing
18 accurate and expedited forensic science and other
19 investigative and laboratory services to local law
20 enforcement agencies and local State's Attorneys in aid of
21 the investigation and trial of capital cases.

1Administration shall exercise the following functions:

3 vested in the Department by the Governor's Office of
4 Management and Budget Act.
5 (2) Pursue research and the publication of studies
6 pertaining to local law enforcement activities.
7 (3) (Blank). Exercise the rights, powers, and duties
8 vested in the Department by the Personnel Code.
9 (4) Operate an electronic data processing and computer
10 center for the storage and retrieval of data pertaining to
11 criminal activity.
12 (5) Exercise the rights, powers, and duties vested in
13 the former Division of State Troopers by Section 17 of the
14 State Police Act.
15 (6) (Blank). Exercise the rights, powers, and duties
16 vested in the Department by "An Act relating to internal
17 auditing in State government", approved August 11, 1967
18 (repealed; now the Fiscal Control and Internal Auditing
19 Act, 30 ILCS 10/).
20 (6.5) Exercise the rights, powers, and duties vested in
21 the Department by the Firearm Owners Identification Card
22 Act.
23 (7) Exercise other duties that may be assigned by the
24 Director to fulfill the responsibilities and achieve the
25 purposes of the Department.
26 (8) Exercise the rights, powers, and duties vested by
