Bill Title: Amends the Illinois Police Training Act. Provides that the Law Enforcement Training Assistance Fund is created as a nonappropriated State trust fund within the State treasury. Provides that all gifts, donations, and charitable contributions that are contributed by any public or private individual or entity to the Illinois Law Enforcement Training Standards Board for the purpose of supporting local law enforcement training shall be deposited into this Fund. Amends the Law Enforcement Intern Training Act. Creates the Correctional Officer Intern Program. To be eligible to participate, the person must meet the minimum criteria established by the Illinois Law Enforcement Training Standards Board that includes, but is not limited to, physical fitness standards, educational standards, psychological standards, being at least 21 years of age, of good character, and not convicted of a felony offense or other crime involving moral turpitude under the laws of this State or any other State that, if convicted in this State, would be punishable as a felony or a crime of moral turpitude. Provides that the Board shall require correctional interns to undertake, at a minimum, the same training requirements as established for correctional officers. Provides that the Board certificate reserved for correctional officers shall not be awarded until the correctional intern is employed, has successfully completed the State certification exam, and meets the requirements. Makes other conforming changes. Effective immediately.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 15. The Law Enforcement Intern Training Act is
5amended by changing Sections 5, 10, 15, 20, and 25 and by
6adding Sections 22 and 23 as follows:

8 Sec. 5. Definitions. As used in this Act:
9 "Academy" means a school certified by the Illinois Law
10Enforcement Training Standards Board to provide basic training
11under Section 6 of the Illinois Police Training Act.
12 "Board" means the Illinois Law Enforcement Training
13Standards Board created by the Illinois Police Training Act.
14 "Correctional Intern" means a civilian who has met the
15requirements to enter the Correctional Intern Training Program
16and who is not employed as a correctional officer under the
17Illinois Police Training Act.
18 "Graduate Correctional Intern" means a civilian who has
19successfully completed the correctional intern training course
20and is not employed as a correctional officer under the
21Illinois Police Training Act.
22 "Law Enforcement Intern" means a civilian who has met the
23requirements to enter the Law Enforcement Intern Training

1Program and who is not employed as a law enforcement officer
2under the Illinois Police Training Act.
3 "Graduate Law Enforcement Intern" means a civilian who has
4successfully completed the law enforcement intern training
5course and is not employed as a law enforcement officer under
6the Illinois Police Training Act.
7 "Trainee" means a law enforcement intern who is enrolled in
8the Law Enforcement Intern Training Program.

11 Sec. 10. Initiation, administration, and conduct of
12program by Board. The Board may initiate, administer, and
13conduct the Law Enforcement Intern Training Program and the
14Correctional Officer Intern Program. The training for law
15enforcement interns shall be provided at any certified academy
16selected by the Board. The Board shall have the authority to
17establish enrollment limitations.

20 Sec. 15. Election to participate in the Law Enforcement
21Intern Training Program program. Any person may elect to apply
22to participate in the Law Enforcement Intern Training Program.
23To be eligible to participate, the person must meet the minimum
24criteria established by the Board that includes, but is not

1limited to, physical fitness standards, educational standards,
2psychological standards, 21 years of age, of good character,
3and not convicted of a felony offense or other crime involving
4moral turpitude under the laws of this State or any other State
5that, if convicted in this State, would be punishable as a
6felony or a crime of moral turpitude. Applicants shall be
7accepted for the program on a person by person basis and shall
8not take the place of or prevent a law enforcement officer from
9entering an academy class to meet the basic training
10requirements set forth in the Illinois Police Training Act.
11When reviewing applications, special consideration shall be
12given to persons who have been members of the Armed Forces of
13the United States in accordance with the Veterans Preference
14Act. The Board's investigators shall enforce the provisions of
15this Act to ensure compliance with the Act, including, but not
16limited to, administrating a criminal justice background check
17that includes State and federal criminal histories, conducting
18interviews, obtaining, by subpoena if necessary, investigative
19records, police records, personnel records, or other records
20that may be needed.
21 Nothing in this Act shall override or replace, preempt, or
22supersede, any hiring or selection standard, process,
23procedure, requirement, or mechanism established by any local
24governmental unit, or State statute or regulation that is in
25effect or amended hereafter.

2 Sec. 20. Law enforcement certification Certification;
3transition course. The Board shall require law enforcement
4interns to undertake, at a minimum, the same training
5requirements as established for law enforcement officers under
6the Illinois Police Training Act. The Board certificate
7reserved for law enforcement officers shall not be awarded
8until the law enforcement intern is employed, has successfully
9completed the State certification exam, and meets the
10requirements established by the Board. The Law Enforcement
11Intern Certificate shall be issued to the trainee following the
12successful completion of the course. The graduate law
13enforcement intern, if not employed as a law enforcement
14officer within 2 years after issuance of the law enforcement
15intern certificate, must then meet the requirements of the
16Illinois Police Training Act upon employment. A graduate law
17enforcement intern who is not employed within one year, but is
18hired within 2 years after completing the course, must
19successfully complete a transition course approved by the
20Illinois Law Enforcement Training Standards Board and again
21successfully complete the law enforcement State certification
22exam in order to obtain the Board's certificate reserved for
23law enforcement officers. The transition course shall consist
24of a minimum of 80 hours and shall be conducted at a Board
25certified academy.

15person basis and shall not take the place of or prevent a
16correctional officer from entering an academy class to meet the
17basic training requirements set forth in the Illinois Police
18Training Act. When reviewing applications, special
19consideration shall be given to persons who have been members
20of the Armed Forces of the United States in accordance with the
21Veterans Preference Act. The Board's investigators shall
22enforce this Act to ensure compliance with the Act, including,

11officers under the Illinois Police Training Act. The Board
12certificate reserved for correctional officers shall not be
13awarded until the correctional intern is employed, has
14successfully completed the State certification exam, and meets
15the requirements established by the Board. The correctional
16intern certificate shall be issued to the trainee following the
17successful completion of the course. The graduate correctional
18intern, if not employed as a correctional officer within 2
19years after issuance of the correctional intern certificate,
20must then meet the requirements of the Illinois Police Training
21Act upon employment.

23 Sec. 25. Police Training Board Services Fund. The Board
24shall charge, collect, or receive fees, tuition, or moneys from

1persons electing to enter the Law Enforcement Intern Training
2Program or the Correctional Officer Intern Program equivalent
3to the costs of providing personnel, equipment, services, and
4training to law enforcement interns that, in the judgement of
5the Board, are in the best interest of the State.
6 All fees or moneys received by the Board under this Act
7shall be deposited in a special fund in the State Treasury to
8be known as the Police Training Board Services Fund. The moneys
9deposited in the Police Training Board Services Fund shall be
10appropriated to the Board for expenses of the Board for the
11administration and conduct of training.

13 Section 99. Effective date. This Act takes effect upon
14becoming law.
