Bill Title: Reinserts the provisions of the introduced bill, and provides that the Abraham Lincoln Presidential Library and Museum Act, to the extent that there is a conflict between the provisions of Executive Order 2017-1 and the Act, supersedes the Executive Order, and shall be controlling.

1 | AN ACT concerning State government.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Abraham Lincoln Presidential Library and | |||||||||||||||||||||||||
5 | Museum Act is amended by changing Sections 30, 35, and 45 as | |||||||||||||||||||||||||
6 | follows:

8 | Sec. 30. Administration of the Agency. The Agency shall be | |||||||||||||||||||||||||
9 | under the supervision and direction of an Executive Director. | |||||||||||||||||||||||||
10 | The person serving on the effective date of this Act as Library | |||||||||||||||||||||||||
11 | Director, as defined in Section 33 of the Historic Preservation | |||||||||||||||||||||||||
12 | Act, shall become the inaugural Executive Director on the | |||||||||||||||||||||||||
13 | effective date of this Act and shall serve as Executive | |||||||||||||||||||||||||
14 | Director until the expiration of his then-current term as | |||||||||||||||||||||||||
15 | Library Director. Thereafter, the Board shall appoint the | |||||||||||||||||||||||||
16 | Executive Director with the advice and consent of the Senate. | |||||||||||||||||||||||||
17 | The Executive Director shall serve at the pleasure of the Board | |||||||||||||||||||||||||
18 | for a term of 4 years. The Executive Director shall, subject to | |||||||||||||||||||||||||
19 | applicable provisions of law, execute and discharge the powers | |||||||||||||||||||||||||
20 | and duties of the Agency. The Executive Director shall have | |||||||||||||||||||||||||
21 | hiring power and shall appoint (a) a Facilities Services | |||||||||||||||||||||||||
22 | Library Facilities Operations Director; and (b) a Director of | |||||||||||||||||||||||||
23 | the Library Services Director . The Executive Director shall |

1 | appoint those other employees of the Agency as he or she deems | ||||||
2 | appropriate and shall fix the compensation of the Facilities | ||||||
3 | Services Library Facilities Operations Director, the Director | ||||||
4 | of the Library Services Director, and other employees. The | ||||||
5 | Executive Director may make provision to establish and collect | ||||||
6 | admission and registration fees, operate a gift shop, and | ||||||
7 | publish and sell educational and informational materials.

10 | Sec. 35. State Historian; exchange historical records. The | ||||||
11 | State Historian shall make all necessary rules, regulations, | ||||||
12 | and bylaws not inconsistent with law to carry into effect the | ||||||
13 | purposes of this Act and to procure from time to time as may be | ||||||
14 | possible and practicable, at reasonable costs, all books, | ||||||
15 | pamphlets, manuscripts, monographs, writings, and other | ||||||
16 | material of historical interest and useful to the historian | ||||||
17 | bearing upon the political, physical, religious, or social | ||||||
18 | history of the State of Illinois from the earliest known period | ||||||
19 | of time. The State Historian may, with the consent of the | ||||||
20 | Executive Director Board , exchange any books, pamphlets, | ||||||
21 | manuscripts, records, or other materials which such library may | ||||||
22 | acquire that are of no historical interest or for any reason | ||||||
23 | are of no value to it, with any other library, school or | ||||||
24 | historical society. The State Historian shall distribute | ||||||
25 | volumes of the series known as the Illinois Historical |

1 | Collections now in print, and to be printed, to all who may | ||||||
2 | apply for same and who pay to the Library and Museum for such | ||||||
3 | volumes an amount fixed by the State Historian sufficient to | ||||||
4 | cover the expenses of printing and distribution of each volume | ||||||
5 | received by such applicants. However, the State Historian shall | ||||||
6 | have authority to furnish 25 of each of the volumes of the | ||||||
7 | Illinois Historical Collections, free of charge, to each of the | ||||||
8 | authors and editors of the Collections or parts thereof; to | ||||||
9 | furnish, as in his or her discretion he or she deems necessary | ||||||
10 | or desirable, a reasonable number of each of the volumes of the | ||||||
11 | Collections without charge to archives, libraries, and similar | ||||||
12 | institutions from which material has been drawn or assistance | ||||||
13 | has been given in the preparation of such Collections, and to | ||||||
14 | the officials thereof; and to furnish, as in his or her | ||||||
15 | discretion he or she deems necessary or desirable, a reasonable | ||||||
16 | number of each of the volumes of the Collections without charge | ||||||
17 | to the University of Illinois Library and to instructors and | ||||||
18 | officials of that University, and to public libraries in the | ||||||
19 | State of Illinois. The State Historian may, with the consent of | ||||||
20 | the Board, also make exchanges of the Historical Collections | ||||||
21 | with any other library, school or historical society, and | ||||||
22 | distribute volumes of the Collections for review purposes.

25 | Sec. 45. State Historian; historical records. The State |

1 | Historian shall establish and supervise a program within the | ||||||
2 | Agency designed to preserve as historical records selected past | ||||||
3 | editions of newspapers of this State. Such editions and other | ||||||
4 | materials shall be preserved in accordance with industry | ||||||
5 | standards and shall be stored in a place provided by the | ||||||
6 | Agency . The negatives of microphotographs and other materials | ||||||
7 | shall be stored in a place provided by the Agency. | ||||||
8 | The State Historian shall determine on the basis of | ||||||
9 | historical value the
various newspaper edition files which | ||||||
10 | shall be preserved and shall
arrange a schedule for such | ||||||
11 | preservation. The State Historian or his or her designee shall | ||||||
12 | work with library personnel in shall
supervise the making of | ||||||
13 | arrangements for acquiring access to past edition
files and | ||||||
14 | copyright permissions with the editors or publishers of the | ||||||
15 | various newspapers.

16 | The method of microphotography to be employed in this | ||||||
17 | program shall
conform to the standards established pursuant to | ||||||
18 | Section 17 of the State
Records Act. | ||||||
19 | Upon payment to the Agency of the required fee, any person | ||||||
20 | or organization shall be granted access to the preserved | ||||||
21 | editions of newspapers and all records supplied with any prints | ||||||
22 | requested to be made from the newspapers and all records . The | ||||||
23 | fee required shall be determined by the State Historian and | ||||||
24 | shall be equal in amount to the costs incurred by the Agency in | ||||||
25 | granting such access supplying the requested prints .
