1 AN ACT concerning finance.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 1. References to Act. This Act may be referred to
5as the Illinois Partners for Nutrient Loss Reduction Act.
6 Section 3. Findings. The General Assembly finds that:
7 (1) Excessive levels of nutrients are degrading the quality
8of streams, rivers, and lakes within the State of Illinois and
9contributing to the dead zone in the Gulf of Mexico.
10 (2) The State's Environmental Protection Agency and
11Department of Agriculture collaborated with the Policy Working
12Group, working with academics, environmental nonprofits,
13representatives of federal, State, and local agencies,
14wastewater treatment professionals, and the agricultural
15community to develop the Illinois Nutrient Loss Reduction
16Strategy in 2015. They continue to collaborate to implement the
17Strategy.
18 (3) The Strategy sets a milestone to reduce nitrogen loads
19in Illinois waters that leave the State by 15% and phosphorus
20loads by 25% by 2025 from baseline levels of 1980-1996. One
21goal is to reduce both nitrogen and phosphorus loads by 45%.
22 (4) The Environmental Protection Agency and the Department
23of Agriculture require resources to administer and implement

1the Strategy in order to meet the Strategy's 2025 milestone and
2goal.
3 (5) Units of local government require assistance in
4developing nutrient assessment reduction plans and financing
5the construction of nutrient capture infrastructure to meet the
6goals of the Strategy.
7 (6) Nutrient capture practices cost share grants will
8assist Illinois' agricultural economy in meeting the goals of
9the Strategy.
10 (7) Soil and Water Conservation Districts assist Illinois
11farmers in implementing nutrient capture practices on their
12farmland.
13 Section 5. The State Finance Act is amended by changing
14Sections 5.411, 6z-27, 6z-32, 6z-63, 6z-64, 8.49, and 8.50 as
15follows:

22transferred, appropriated and used only for the purposes
23authorized by, and subject to the limitations and conditions

2 Within 30 days after the effective date of this amendatory
3Act of the 101st General Assembly, the State Comptroller shall
4order transferred and the State Treasurer shall transfer from
5the following funds moneys in the specified amounts for deposit
6into the Audit Expense Fund:

25 Notwithstanding any provision of the law to the contrary,
26the General Assembly hereby authorizes the use of such funds

1for the purposes set forth in this Section.
2 These provisions do not apply to funds classified by the
3Comptroller as federal trust funds or State trust funds. The
4Audit Expense Fund may receive transfers from those trust funds
5only as directed herein, except where prohibited by the terms
6of the trust fund agreement. The Auditor General shall notify
7the trustees of those funds of the estimated cost of the audit
8to be incurred under the Illinois State Auditing Act for the
9fund. The trustees of those funds shall direct the State
10Comptroller and Treasurer to transfer the estimated amount to
11the Audit Expense Fund.
12 The Auditor General may bill entities that are not subject
13to the above transfer provisions, including private entities,
14related organizations and entities whose funds are
15locally-held, for the cost of audits, studies, and
16investigations incurred on their behalf. Any revenues received
17under this provision shall be deposited into the Audit Expense
18Fund.
19 In the event that moneys on deposit in any fund are
20unavailable, by reason of deficiency or any other reason
21preventing their lawful transfer, the State Comptroller shall
22order transferred and the State Treasurer shall transfer the
23amount deficient or otherwise unavailable from the General
24Revenue Fund for deposit into the Audit Expense Fund.
25 On or before December 1, 1992, and each December 1
26thereafter, the Auditor General shall notify the Governor's

1Office of Management and Budget (formerly Bureau of the Budget)
2of the amount estimated to be necessary to pay for audits,
3studies, and investigations in accordance with the Illinois
4State Auditing Act during the next succeeding fiscal year for
5each State fund for which a transfer or reimbursement is
6anticipated.
7 Beginning with fiscal year 1994 and during each fiscal year
8thereafter, the Auditor General may direct the State
9Comptroller and Treasurer to transfer moneys from funds
10authorized by the General Assembly for that fund. In the event
11funds, including federal and State trust funds but excluding
12the General Revenue Fund, are transferred, during fiscal year
131994 and during each fiscal year thereafter, in excess of the
14amount to pay actual costs attributable to audits, studies, and
15investigations as permitted or required by the Illinois State
16Auditing Act or specific action of the General Assembly, the
17Auditor General shall, on September 30, or as soon thereafter
18as is practicable, direct the State Comptroller and Treasurer
19to transfer the excess amount back to the fund from which it
20was originally transferred.

24 Sec. 6z-32. Partners for Planning and Conservation.
25 (a) The Partners for Nutrient Loss Reduction Conservation

1Fund (formerly known as the Partners for Conservation Fund and
2the Conservation 2000 Fund) and the Partners for Conservation
3Projects Fund (formerly known as the Conservation 2000 Projects
4Fund) are created as special funds in the State Treasury. These
5funds shall be used to establish a comprehensive program to
6protect Illinois' natural resources through cooperative
7partnerships between State government and public and private
8landowners. Moneys in these Funds may be used, subject to
9appropriation, by the Department of Natural Resources,
10Environmental Protection Agency, and the Department of
11Agriculture for purposes relating to natural resource
12protection, planning, recreation, tourism, and compatible
13agricultural and economic development activities. Without
14limiting these general purposes, moneys in these Funds may be
15used, subject to appropriation, for the following specific
16purposes:
17 (1) To foster sustainable agriculture practices and
18 control soil erosion, and sedimentation, and nutrient loss
19 from farmland, including grants to Soil and Water
20 Conservation Districts for conservation practice
21 cost-share grants and for personnel, educational, and
22 administrative expenses.
23 (2) To establish and protect a system of ecosystems in
24 public and private ownership through conservation
25 easements, incentives to public and private landowners,
26 natural resource restoration and preservation, water

1 quality protection and improvement, land use and watershed
2 planning, technical assistance and grants, and land
3 acquisition provided these mechanisms are all voluntary on
4 the part of the landowner and do not involve the use of
5 eminent domain.
6 (3) To develop a systematic and long-term program to
7 effectively measure and monitor natural resources and
8 ecological conditions through investments in technology
9 and involvement of scientific experts.
10 (4) To initiate strategies to enhance, use, and
11 maintain Illinois' inland lakes through education,
12 technical assistance, research, and financial incentives.
13 (5) To partner with private landowners and with units
14 of State, federal, and local government and with
15 not-for-profit organizations in order to integrate State
16 and federal programs with Illinois' natural resource
17 protection and restoration efforts and to meet
18 requirements to obtain federal and other funds for
19 conservation or protection of natural resources.
20 (6) To implement the State's Nutrient Loss Reduction
21 Strategy, including, but not limited to, funding the
22 resources needed to support the Strategy's Policy Working
23 Group, cover water quality monitoring in support of
24 Strategy implementation, prepare a biennial report on the
25 progress made on the Strategy every 2 years, and provide
26 cost share funding for nutrient capture projects, nutrient

1 capture infrastructure, and nutrient assessment and
2 reduction plan development.
3 (b) The State Comptroller and State Treasurer shall
4automatically transfer on the last day of each month, beginning
5on September 30, 1995 and ending on June 30, 2026 2021, from
6the General Revenue Fund to the Partners for Nutrient Loss
7Reduction Conservation Fund, an amount equal to 1/10 of the
8amount set forth below in fiscal year 1996 and an amount equal
9to 1/12 of the amount set forth below in each of the other
10specified fiscal years:

2 (c) Notwithstanding any other provision of law to the
3contrary and in addition to any other transfers that may be
4provided for by law, on the last day of each month beginning on
5July 31, 2006 and ending on June 30, 2007, or as soon
6thereafter as may be practical, the State Comptroller shall
7direct and the State Treasurer shall transfer $1,000,000 from
8the Open Space Lands Acquisition and Development Fund to the
9Partners for Nutrient Loss Reduction Conservation Fund
10(formerly known as the Partners for Conservation Fund and the
11Conservation 2000 Fund).
12 (d) There shall be deposited into the Partners for
13Conservation Projects Fund such bond proceeds and other moneys
14as may, from time to time, be provided by law.
15 (e) For years 2021 through 2026, $11,075,000 from the
16Partners for Nutrient Loss Reduction Fund shall be provided
17annually to the Agency and used as follows:
18 (1) $530,000 for coordination of Illinois Nutrient
19 Loss Reduction Strategy implementation, including, but not
20 limited to, meeting coordination, reporting, and watershed
21 coordination;
22 (2) $545,000 to cover water quality monitoring in
23 support of Strategy implementation;
24 (3) $1,000,000 as cost share for Nutrient Assessment
25 Reduction Plan development; and
26 (4) $9,000,000 for nutrient capture infrastructure

1 cost share.
2 (f) For years 2022 through 2026, $17,500,000 funding from
3the Partners for Nutrient Loss Reduction Fund shall be provided
4annually to the Department and used as follows:
5 (1) $8,000,000 to Soil and Water Conservation
6 Districts for personnel, educational, and administrative
7 expenses; and
8 (2) $9,500,000 for nutrient capture practices cost
9 share grants.
10 In this Section:
11 "Agency" means the Illinois Environmental Protection
12Agency.
13 "Department" means the Department of Agriculture.
14 "Nutrient assessment reduction plan" means a plan
15developed by a wastewater facility with other watershed
16stakeholders to assess and reduce nutrient-related problems in
17the waterway downstream of the wastewater facility.
18 "Nutrient capture infrastructure" means construction of
19wastewater infrastructure designed to reduce the levels of
20phosphorus and nitrogen in a wastewater facility's effluent
21discharge.
22 "Nutrient capture practices" means practices that will
23reduce the levels of phosphorus and nitrogen lost from
24farmland, including, but not limited to, grade stabilization
25structures, grassed waterways, cover crops, narrow based
26terraces, water and sediment control basins, streambank and

1stream channel stabilization and restoration, constructed
2wetlands, denitrifying bioreactors, filter strips, saturated
3buffers, structures for water control, 2-stage ditches, forest
4management, livestock exclusion, permanent vegetative cover,
5sinkhole stabilization, tree planting, and other innovative
6conservation systems that can reduce nutrient loss.
7 "Strategy" means the 2015 Illinois Nutrient Loss Reduction
8Strategy document and its biennial reports of 2017 and 2019.

11 Sec. 6z-63. The Professional Services Fund.
12 (a) The Professional Services Fund is created as a
13revolving fund in the State treasury. The following moneys
14shall be deposited into the Fund:
15 (1) amounts authorized for transfer to the Fund from
16 the General Revenue Fund and other State funds (except for
17 funds classified by the Comptroller as federal trust funds
18 or State trust funds) pursuant to State law or Executive
19 Order;
20 (2) federal funds received by the Department of Central
21 Management Services (the "Department") as a result of
22 expenditures from the Fund;
23 (3) interest earned on moneys in the Fund; and
24 (4) receipts or inter-fund transfers resulting from
25 billings issued by the Department to State agencies for the

1 cost of professional services rendered by the Department
2 that are not compensated through the specific fund
3 transfers authorized by this Section.
4 (b) Moneys in the Fund may be used by the Department for
5reimbursement or payment for:
6 (1) providing professional services to State agencies
7 or other State entities;
8 (2) rendering other services to State agencies at the
9 Governor's direction or to other State entities upon
10 agreement between the Director of Central Management
11 Services and the appropriate official or governing body of
12 the other State entity; or
13 (3) providing for payment of administrative and other
14 expenses incurred by the Department in providing
15 professional services.
16 (c) State agencies or other State entities may direct the
17Comptroller to process inter-fund transfers or make payment
18through the voucher and warrant process to the Professional
19Services Fund in satisfaction of billings issued under
20subsection (a) of this Section.
21 (d) Reconciliation. For the fiscal year beginning on July
221, 2004 only, the Director of Central Management Services (the
23"Director") shall order that each State agency's payments and
24transfers made to the Fund be reconciled with actual Fund costs
25for professional services provided by the Department on no less
26than an annual basis. The Director may require reports from

1State agencies as deemed necessary to perform this
2reconciliation.
3 (e) The following amounts are authorized for transfer into
4the Professional Services Fund for the fiscal year beginning
5July 1, 2004:

4soon thereafter as practical. These transfers shall be made
5notwithstanding any other provision of State law to the
6contrary.
7 (e-5) Notwithstanding any other provision of State law to
8the contrary, on or after July 1, 2005 and through June 30,
92006, in addition to any other transfers that may be provided
10for by law, at the direction of and upon notification from the
11Director of Central Management Services, the State Comptroller
12shall direct and the State Treasurer shall transfer amounts
13into the Professional Services Fund from the designated funds
14not exceeding the following totals:

5 Sec. 6z-64. The Workers' Compensation Revolving Fund.
6 (a) The Workers' Compensation Revolving Fund is created as
7a revolving fund, not subject to fiscal year limitations, in
8the State treasury. The following moneys shall be deposited
9into the Fund:
10 (1) amounts authorized for transfer to the Fund from
11 the General Revenue Fund and other State funds (except for
12 funds classified by the Comptroller as federal trust funds
13 or State trust funds) pursuant to State law or Executive
14 Order;
15 (2) federal funds received by the Department of Central
16 Management Services (the "Department") as a result of
17 expenditures from the Fund;
18 (3) interest earned on moneys in the Fund;
19 (4) receipts or inter-fund transfers resulting from
20 billings issued to State agencies and universities for the
21 cost of workers' compensation services that are not
22 compensated through the specific fund transfers authorized
23 by this Section, if any;
24 (5) amounts received from a State agency or university
25 for workers' compensation payments for temporary total

1 disability, as provided in Section 405-105 of the
2 Department of Central Management Services Law of the Civil
3 Administrative Code of Illinois; and
4 (6) amounts recovered through subrogation in workers'
5 compensation and workers' occupational disease cases.
6 (b) Moneys in the Fund may be used by the Department for
7reimbursement or payment for:
8 (1) providing workers' compensation services to State
9 agencies and State universities; or
10 (2) providing for payment of administrative and other
11 expenses (and, beginning January 1, 2013, fees and charges
12 made pursuant to a contract with a private vendor) incurred
13 in providing workers' compensation services. The
14 Department, or any successor agency designated to enter
15 into contracts with one or more private vendors for the
16 administration of the workers' compensation program for
17 State employees pursuant to subsection 10b of Section
18 405-105 of the Department of Central Management Services
19 Law of the Civil Administrative Code of Illinois, is
20 authorized to establish one or more special funds, as
21 separate accounts provided by any bank or banks as defined
22 by the Illinois Banking Act, any savings and loan
23 association or associations as defined by the Illinois
24 Savings and Loan Act of 1985, or any credit union as
25 defined by the Illinois Credit Union Act, to be held by the
26 Director outside of the State treasury, for the purpose of

1 receiving the transfer of moneys from the Workers'
2 Compensation Revolving Fund. The Department may promulgate
3 rules further defining the methodology for the transfers.
4 Any interest earned by moneys in the funds or accounts
5 shall be deposited into the Workers' Compensation
6 Revolving Fund. The transferred moneys, and interest
7 accrued thereon, shall be used exclusively for transfers to
8 contracted private vendors or their financial institutions
9 for payments to workers' compensation claimants and
10 providers for workers' compensation services, claims, and
11 benefits pursuant to this Section and subsection 9 of
12 Section 405-105 of the Department of Central Management
13 Services Law of the Civil Administrative Code of Illinois.
14 The transferred moneys, and interest accrued thereon,
15 shall not be used for any other purpose including, but not
16 limited to, reimbursement or payment of administrative
17 fees due the contracted vendor pursuant to its contract or
18 contracts with the Department.
19 (c) State agencies may direct the Comptroller to process
20inter-fund transfers or make payment through the voucher and
21warrant process to the Workers' Compensation Revolving Fund in
22satisfaction of billings issued under subsection (a) of this
23Section.
24 (d) Reconciliation. For the fiscal year beginning on July
251, 2004 only, the Director of Central Management Services (the
26"Director") shall order that each State agency's payments and

1transfers made to the Fund be reconciled with actual Fund costs
2for workers' compensation services provided by the Department
3and attributable to the State agency and relevant fund on no
4less than an annual basis. The Director may require reports
5from State agencies as deemed necessary to perform this
6reconciliation.
7 (d-5) Notwithstanding any other provision of State law to
8the contrary, on or after July 1, 2005 and until June 30, 2006,
9in addition to any other transfers that may be provided for by
10law, at the direction of and upon notification of the Director
11of Central Management Services, the State Comptroller shall
12direct and the State Treasurer shall transfer amounts into the
13Workers' Compensation Revolving Fund from the designated funds
14not exceeding the following totals:

3 (b) On and after the effective date of this amendatory Act
4of the 96th General Assembly through June 30, 2010, when any of
5the funds listed in subsection (a) have insufficient cash from
6which the State Comptroller may make expenditures properly
7supported by appropriations from the fund, then the State
8Treasurer and State Comptroller shall transfer from the General
9Revenue Fund to the fund such amount as is immediately
10necessary to satisfy outstanding expenditure obligations on a
11timely basis, subject to the provisions of the State Prompt
12Payment Act.
13 (c) If the Director of the Governor's Office of Management
14and Budget determines that any transfer to the General Revenue
15Fund from a special fund under subsection (a) either (i)
16jeopardizes federal funding based on a written communication
17from a federal official or (ii) violates an order of a court of
18competent jurisdiction, then the Director may order the State
19Treasurer and State Comptroller, in writing, to transfer from
20the General Revenue Fund to that listed special fund all or
21part of the amounts transferred from that special fund under
22subsection (a).
23 (d) In addition to any other transfers that may be provided
24for by law, on December 1, 2010, or as soon thereafter as may
25be practical, the State Comptroller shall direct and the State
26Treasurer shall transfer the following amounts from the General

9 Sec. 8.50. Special fund transfers.
10 (a) In order to maintain the integrity of special funds and
11improve stability in the General Revenue Fund, the following
12transfers are authorized from the designated funds into the
13General Revenue Fund:

3 (b) In order to maintain the integrity of special funds and
4improve stability in the General Obligation Bond Retirement and
5Interest Fund, the following transfer is authorized from the
6designated fund into the General Obligation Bond Retirement and
7Interest Fund:
8Federal High Speed Rail Trust Fund................$48,000,000
9 (c) On and after the effective date of this amendatory Act
10of the 99th General Assembly through the end of State fiscal
11year 2015, when any of the funds listed in subsection (a) has
12insufficient cash from which the State Comptroller may make
13expenditures properly supported by appropriations from the
14fund, then, at the direction of the Director of the Governor's
15Office of Management and Budget, the State Treasurer and State
16Comptroller shall transfer from the General Revenue Fund to the
17fund only such amount as is immediately necessary to satisfy
18outstanding expenditure obligations on a timely basis, subject
19to the provisions of the State Prompt Payment Act. All or a
20portion of the amounts transferred from the General Revenue
21Fund to a fund pursuant to this subsection (c) from time to
22time may be re-transferred by the State Comptroller and the
23State Treasurer from the receiving fund into the General
24Revenue Fund as soon as and to the extent that deposits are
25made into or receipts are collected by the receiving fund.
26 (d) The State Treasurer and State Comptroller shall

1transfer the amounts designated under subsections (a) and (b)
2of this Section as soon as may be practicable after receiving
3the direction to transfer from the Director of the Governor's
4Office of Management and Budget. If the Director of the
5Governor's Office of Management and Budget determines that any
6transfer authorized by this Section from a special fund under
7subsection (a) or (b) either (i) jeopardizes federal funding
8based on a written communication from a federal official or
9(ii) violates an order of a court of competent jurisdiction,
10then the Director may order the State Treasurer and State
11Comptroller, in writing, to (i) transfer from the General
12Revenue Fund to that listed special fund all or part of the
13amounts transferred from that special fund under subsection
14(a), or (ii) transfer from the General Obligation Bond
15Retirement and Interest Fund to that listed special fund all or
16part of the amounts transferred from that special fund under
17subsection (b).
18 (e) For the fourth quarter of State fiscal year 2015, the
19report filed under Section 7.2 of the Governor's Office of
20Management and Budget Act shall contain, in addition to the
21information otherwise required, information on all transfers
22made pursuant to this Section, including all of the following:
23 (1) The date each transfer was made.
24 (2) The amount of each transfer.
25 (3) In the case of a transfer from the General Revenue
26 Fund to a fund of origin pursuant to subsection (c) or (d)

1 of this Section, the amount of such transfer and the date
2 such transfer was made.
3 (4) The end of day balance of both the fund of origin
4 and the General Revenue Fund on the date the transfer was
5 made.
6 (f) Notwithstanding any provision of law to the contrary,
7the transfers in this Section shall be made through the end of
8State fiscal year 2015.
