AN ACT TO CREATE IN THE STATE TREASURY A SPECIAL FUND TO BE KNOWN AS THE "MISSISSIPPI NATIONAL GUARD STATE ACTIVE DUTY EMERGENCY OPERATIONS FUND" FOR THE PURPOSE OF MAINTAINING ANNUAL GENERAL FUND BUDGET RESTRICTIONS AND ENABLING THE MISSISSIPPI MILITARY DEPARTMENT TO RESPOND TO DOMESTIC EVENTS AS DIRECTED BY THE GOVERNOR DURING DECLARED STATES OF EMERGENCY OR IN CONJUNCTION WITH APPROVED EMERGENCY MANAGEMENT ASSISTANCE COMPACTS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  There is hereby created in the State Treasury a special fund to be known as the "Mississippi National Guard State Active Duty Emergency Operations Fund" for the purpose of receiving monies appropriated or otherwise made available in any manner for deposit into the fund for maintaining annual general fund budget restrictions and enabling the Mississippi Military Department to respond to domestic events as directed by the Governor during declared states of emergency or in conjunction with approved emergency management assistance compacts.  Monies in the special fund may be expended by the Mississippi Military Department, upon appropriation by the Legislature.  Unexpended amounts remaining in such special fund at the end of a fiscal year shall not lapse into the State General Fund, and any interest earned or investment earnings on amounts in such special fund shall be deposited to the credit of the special fund.  No state general funds shall be deposited into the special fund.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2017.
