A BILL TO BE ENTITLED

AN ACT to create a board to govern the fire protection services provided to properties by the ten‑ten (fairview) rural fire protection district in wake county.

The General Assembly of North Carolina enacts:

SECTION 1.  The Ten‑Ten (Fairview) Fire Protection Oversight Board is created to govern the fire protection services provided to the properties located within the Ten‑Ten (Fairview) rural fire protection district in Wake County, as that district existed on July 1, 2018.

SECTION 2.  The Ten‑Ten (Fairview) Fire Protection Oversight Board consists of three members appointed as follows: one member appointed by the Wake County Board of Commissioners and two members appointed by the Board of Directors of the Fairview Rural Fire Department. Except for the initial members, members are appointed for three‑year terms and the terms commence on January 1. The Ten‑Ten (Fairview) Fire Protection Oversight Board will select its own chairperson.

The initial board members must be appointed on or before March 1, 2019, and will serve as follows:

(1)        The term of the initial member appointed by the board of county commissioners terminates on December 31, 2019.

(2)        The term of one of the initial members appointed by the Board of Directors of the Fairview Rural Fire Department terminates on December 31, 2020.

(3)        The term of the remaining initial member appointed by the Board of Directors of the Fairview Rural Fire Department terminates on December 31, 2021.

SECTION 3.  The Wake County Board of Commissioners must separately account for the fire district taxes levied and collected on the properties provided fire protection services by the Ten‑Ten (Fairview) rural fire protection district and must furnish this information to the Ten‑Ten (Fairview) Fire Protection Oversight Board on March 1, and at other times upon the request of the Oversight Board.

SECTION 4.  The Ten‑Ten (Fairview) Fire Protection Oversight Board must recommend to the Wake County Board of Commissioners the following:

(1)        The annual budget for the Ten‑Ten (Fairview) rural fire protection district. The budget recommendation may not exceed the amount reported to the Oversight Board on March 1.

(2)        The level, type, and nature of fire protection services to be provided to the properties located within the Ten‑Ten (Fairview) rural fire protection district and the entity or entities to provide those services.

SECTION 5.  The Ten‑Ten (Fairview) Fire Protection Oversight Board must submit its recommendations to the Wake County Board of Commissioners on or before April 30 of each fiscal year. The board of county commissioners must consider the Oversight Board's budget recommendations in its adopted budget for the fiscal year.

SECTION 6.  The Wake County Board of Commissioners must continue to provide the same level, type, and nature of fire protection services to the properties located within the Ten‑Ten (Fairview) rural fire protection district, in the same manner as it is provided on the date this act becomes law.

SECTION 7.  This act applies to Wake County only.

SECTION 8.  This act is effective when it becomes law.
