Short Title:        Boiling Spring Lakes Refund Water Fund.

A BILL TO BE ENTITLED

AN ACT to provide for the return of unused assessments paid to the city of boiling spring lakes.

Whereas, on June 3, 2003, the voters of the City of Boiling Spring Lakes approved a water system referendum; and

Whereas, an assessment was collected to pay for the system; and

Whereas, the City of Boiling Spring Lakes turned the water system over to Brunswick County on May 1, 2010; and

Whereas, there is a balance in the assessment fund that has been retained by the City of Boiling Spring Lakes, with no need to use the funds for the purpose for which they were collected; and

Whereas, there is no mechanism to dispose of the funds; Now, therefore,

The General Assembly of North Carolina enacts:

SECTION 1.  The City of Boiling Spring Lakes shall return unused assessments collected for the water system to the persons that paid those fees, pro rata to the amount paid.

SECTION 2.  This act is effective when it becomes law.
