A BILL TO BE ENTITLED

AN ACT providing that a sanitary district is a public utility subject to regulation by the north carolina utilities commission.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 62‑3(23) is amended by adding a new sub‑subdivision to read as follows:

"l.         Notwithstanding the provisions of sub‑subdivision a.2. and sub‑subdivision d. of this subdivision, the term "public utility" shall include a sanitary district organized under Part 2 of Article 2 of Chapter 130A of the General Statutes."

SECTION 2.  This act becomes effective October 1, 2011.
