A BILL TO BE ENTITLED

AN ACT to prohibit the resale or transfer of lottery tickets and to limit the amount payable to an unlawful prize claimant.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 18C‑132 reads as rewritten:

"§ 18C‑132.  Procedures for drawings and claiming prizes; payment of prizes; protection of information concerning certain prize winners.

(m)       It shall be unlawful to purchase, sell, transfer, or assign the right to claim a prize. A person who violates this subsection shall be guilty of a Class 1 misdemeanor.

(n)        For prize claims made by a person who is not the lawful claimant, the Commission shall only be obligated to pay the amount of consideration paid by the unlawful claimant to obtain the claim. If the Commission discovers that it has overpaid a claim pursuant to this subsection, the amount overpaid to the unlawful claimant shall be subject to the debt setoff provisions under G.S. 18C‑134."

SECTION 2.  This act becomes effective December 1, 2017.
