A BILL TO BE ENTITLED

AN ACT TO GRANT THE RIGHT TO CONSTRUCT AND MAINTAIN A WATER INTAKE SYSTEM in the town of boone.

The General Assembly of North Carolina enacts:

SECTION 1.  The State of North Carolina through special act of the General Assembly expressly grants and conveys to the Town of Boone the right to construct and maintain a water intake system in the waters and submerged land of the South Fork of the New River notwithstanding any public trust rights.  The water intake system shall be located approximately 2,470 linear feet upstream from the center of the Cranberry Springs Road Bridge in the South Fork of the New River in Watauga County, North Carolina.  The dimensions of the intake system shall be 170 feet in length and 55 feet in width.  Nothing in this act shall be construed to relieve the Town of Boone from securing any applicable permits for the project.

SECTION 2.  This act is effective when it becomes law.
