STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty
AN ACT relative to the acceptance of high school course credits from certain schools or education agencies.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Adequate Public Education; Approval of Coursework. Amend RSA 193-E by inserting after section 3-e the following new section:
193-E:3-f Approval of Coursework.
I. The state board of education may approve course work that is satisfactorily completed in another New Hampshire local education agency, state board approved New Hampshire public high school, or the New Hampshire virtual learning academy charter school that meets graduation competencies, as defined in RSA 193-H:1, II, by:
(a) Facilitating student placement within a high school program without disadvantaging such student by variations in scheduling, sequencing, grading, course content, or assessment.
(b) Facilitating the on-time graduation of a student.
(c) Promoting flexibility and cooperation between the educational system, parents, and the student in order to achieve educational success for the student.
II. In this section:
(a) "Local education agency" means a public authority legally constituted by the state as an administrative agency to provide control and direction for kindergarten through grade 12 public educational institutions.
(b) "New Hampshire public high school" means a high school as defined in RSA 194:23.
(c) "Sending school" means the alternative public school from which a student has earned course credit leading toward high school graduation.
III.(a) The principal or other administrator shall approve coursework from a sending school, contingent upon review of the course to ensure the course promotes, meets, or exceeds required knowledge and skills that lead a student to meet competencies offered and measured in the receiving high school.
(b) The principal or other administrator shall approve course credit leading toward high school graduation if a student satisfactorily completes a course offered in another high school. Such courses include but are not limited to honors, International Baccalaureate, advanced placement, vocational, technical, career pathway course, or an approved course of study leading to high school graduation from the sending public school. The principal or other administrator may require the student to satisfactorily complete the local, board approved, in-place competency assessment aligned to a similar course offered through the high school to better determine student competency or to determine that the course meets the academic standards required by the high school.
IV. The local education agency or high school principal shall waive a specific course requirement for graduation if a similar course has been satisfactorily completed in another New Hampshire local education agency, a state board approved New Hampshire public high school, or the New Hampshire virtual learning academy charter school or shall provide reasonable justification for denial. Should a waiver not be granted to a student who would not graduate if the course is not accepted, the local education agency or high school shall offer an alternative means of acquiring required coursework so that graduation may occur on time.
2 Effective Date. This act shall take effect 60 days after its passage.
